Now STAFF REPORT - VA-87-64 APPLICANT: Ampy Smith TAX MAP/PARCEL: 90B/A-36 ZONING: RA (Rural Areas) LOCATION: South side of Route 20 at its intersection with Forrest Road The applicant seeks a variance from Section 30. 5.6. 2. 1 of the Albemarle County Zoning Ordinance. This section pertaining to the location of structures in the Scenic Highway Overlay District , states: "30 . 5.6 .2 SA- Highways 30. 5.6. 2. 1 No buildings or structures other than necessary accessory appurtenant fences and/or walls , except as here- after provided in the case of certain signs, shall be constructed within any SA-highway overlaysdistrict . The Scenic highway overlay district designation and setback dimension is established in Section 30.5.2 . 2 , which states: 30. 5 .2 .2 SA-Highways SA-highways overlay districts are hereby established along the following highway corridors in Albemarle County for a distance of one hundred fifty (150) feet on each side of the right-of-way. 30 .5.2.2 (b) - Virginia Route 20 from Interstate Route 64 south to the corporate limits of the Town of Scottsville The applicant applied for a building permit ( #86-1534) for the construction of an addition to an existing single family dwelling. At the time of issuance of the building permit , the Zoning Department staff did not apply the SA-Highway District setback requirement to this parcel . This oversight has resulted in a need for a variance from the minimum setback of one hundred fifty _(150) feet to ninety- eight (98) feet . The Zoning Department assumes responsibility for the error and requests that the variance be granted. Recommendation The application should be approved.
