Dear Ladies & Gentlemen:
This letter is to inform you that on September 29, 1987, during
the regular meeting of the Albemarle County Board of Zoning
Appeals, that your application for VA-87-54 was approved.
This variance approval allows relief from Section 30.5. 6.2 . 1 of
theā¢ Albemarle County Zoning Ordinance to reduce the setback from
one hundred fifty (150) feet to seventy-five (75) feet to allow
construction of a single-family dwelling on each parcel.

STAFF REPORT - VA-87-54
APPLICANT: Forrest Marshall
TAX MAP/PARCEL: 90B/B-2 , A-35, A-31
ZONING: RA (Rural Areas)
LOCATION: South side of Route 20, at its intersection with
Forest Road
The applicant seeks a variance from Section 30. 5.6 .2 .1 of the Albemarle
County Zoning Ordinance. This section, pertaining to the location of
structures inthe Scenic Highway Overlay District , states:
"30.5.6 .2 SA-Highways
30. 5.6.2.1 No buildings or structures other than necessary
appurtenant fences and/or walls, except as hereafter
provided in the case of certain signs, shall be constructed
within any SA - highways overlay district . "
The scenic highway overlay district designation and setback dimension
is established in Section 30. 5. 2. 2 , which states:
"30. 5.2 .2 SA - Highways
SA - highway overlay districts are hereby established along
the following highway corridors in Albemarle County for a
distance of one hundred fifty (150) feet on each side of
the right-of-way.
30. 5.2 .2 (b) - Virginia Route 20 from Interstate 64 south
to the corporate limits of the Town of Scottsville . "
The applicant proposes to construct a new single family dwelling on
each of the three (3) parcels and seeks a reduction of the setback in
the Scenic Overlay District from one hundred fifty (150) feet to
seventy-five (75) feet . The Marshall Manors Subdivision was created
in 1975 with a required front setback of thirty (30) feet . In the
Marshall Manors Subdivision, three (3) other parcels either have
existing dwellings or there are dwellings presently under construction.
The front yard measurements for these parcels range from a minimum of
eighty-seven (87) feet to a maximum of one hundred forty-four (144)
feet . Variances are also presently being requested for these three (3)
parcels (VA-87-58 , VA-87-59 and VA-87-64) .
Recommendation
The staff believes a variance should be granted in accordance with the
established building pattern of Marshall Manors. The staff would
support a reduction of the required setback from one hundred fifty
(150) to eighty-seven (87) feet .
