THERE ARE SEVERAL POINTS THAT I THINK SHOULD BE MADE ON OUR BEHALF AT THE HEARING: 1. WHILE THE SUPERINTENDENT WHO WAS RESPONSIBLE FOR THE ERROR IS NO LONGER WITH THE COMPANY(NOT BECAUSE OF THE ERROR), WE BELIEVE HE MISTOOK A RIBBON FOR THE SURVEYORS TRAVERSE POINT AS THE MARKING FOR THE SIDELINE. z, 0.CR65 A. THE LOTS ARE SO LARGE, TERRAIN IS VERY UNEVEN, AND THE LOTS ARE HEAVILY WOODED, THEREFORE, YOU CANNOT SEE THE REAR CORNER FROM THE FRONT, SO WE HAVE THE SURVEYOR PLACE A RIBBON ALONG THE SIDELINE. 2.WHILE THE HOUSE ON LOT 43 IS INFRINGING, IT IS STILL 70+ FEET AWAY FROM THE CLOSEST POINT ON THE HOUSE ON LOT 44. 3. LOT 43 AND 44 ARE UNDER CONTRACT AND BOTH PURCHASERS ARE AWARE OF THIS SITUATION. A. LOT 43 PURCHASER HAS ELECTED TO OCCUPY WITH THE HOPE THAT YOU WILL GRANT A VARIANCE, OBVIOUSLY FEELING THIS DOES NOT AFFECT HIS QUIET ENJOYMENT OF THE PROPERTY. B. LOT 44 PURCHASER WAS MADE AWARE OF THE SITUATION AND WAS OFFERED A REFUND OF THEIR DEPOSIT AND VOIDING OF THE CONTRACT IF THEY FELT THEIR VALUE WAS DIMINISHED. THEY DID NOT ACCEPT THE OFFER. 4. IF THE POINT HAS NOT ALREADY BEEN MADE, I THINK THE BOARD SHOULD BE AWARE THAT THE HOUSE IS COMPLETE AND A CERTIFICATE OF OCCUPANCE HAS BEEN GRANTED.
