This variance approval allows relief from Section 30.5. 6.2 . 1 of the Albemarle County Zoning Ordinance to reduce the setback from one hundred fifty (150) feet to seventy-five (75) feet to allow construction of a single-family dwelling. If you have any questions, please contact our office. Sincerely, C,4441ec 'lt1. /3N49ess Charles W. Burgess, Jr. Zoning Administrator CWB,JR/st cc: Inspections Department Robert H. Blodinger STAFF REPORT - VA-87-58 APPLICANT: Melvin Shank TAX MAP/PARCEL: 90B/A-30 ZONING: RA (Rural Areas) LOCATION: South side of Route 20 at its intersection with Forest Road The applicant seeks a variance from Section 30. 5.6. 2. 1 of the Albemarle County Zoning Ordinance . This section pertaining to the location of structures in the Scenic Highway Overlay District , states: "30. 5.6 . 2 SA-Highways 30. 5.6 . 2. 1 No buildings or structures other than necessary accessory appurtenant fences and/or walls , except as here- after provided in the case of certain signs , shall be constructed within any SA-highways overlay district . " The Scenic Highway Overlay District designation and setback dimension is established in Section 30. 5. 2 . 2 , which states: "30. 5. 2.2 SA-Highways SA-highways overlay districts are hereby established along the following highway corridors in Albemarle County for a distance of one hundred fifty (150) feet on each side of the right-of-way . 30. 5.2. 2 (b) Virginia Route 20 from Interstate Route 64 south to the corporate limits of the Town of Scottsville. " The applicant applied for a building permit ( #81-689NR) on June 1 , 1987, for the construction of a new single family dwelling. At the time of the issuance of the building permit , the Zoning Department staff did not apply the SA-Highway Overlay District setback requirement to this parcel . This oversight has resulted in a need for a variance from the minimum setback of one hundred fifty (150) feet to one hundred forty-four (144) feet . The Zoning Department assumes responsibility for the error and requests that the variance be granted. Recommendation The application should be approved.
