Dear Ms. Garth:
This letter is to inform you that on September 29, 1987, during
the regular meeting of the Albemarle County Board of Zoning
Appeals, your application for VA-87-59 was approved.
This variance approval allows relief from Section 30. 5. 6.2 . 1 of
the Albemarle County Zoning Ordinance to reduce the setback from
one hundred fifty (150) feet to seventy-five (75) feet to allow
a single-family dwelling.

LOCATION: South side of Route 20 at its intersection with
Forrest Road
The applicant seeks a variance from Section 30. 5 .6.2 . 1 of the Albemarle
County Zoning Ordinance. This section pertaining to the location of
structures in the Scenic Highway Overlay District , states:
"30. 5.6.2 SA-Highways
30. 5.6.2 . 1 No buildings or structures other than necessary
accessory appurtenant fences and/or walls, except as here-
after provided in the case of certain signs, shall be
constructed within any SA-highways overlay district .
The Scenic Highway Overlay District designation and setback dimension
is established in Section 30 . 5. 2. 2 , which states:
30. 5.2.2 SA-Highways
SA-Highway overlay districts are hereby established along
the following highway corridors in Albemarle County for a
distance of one hundred fifty (150) feet on each side of
the right-of-way:
30. 5.2 .2. (b) Virginia Route 20 from Interstate Route 64
south to the corporate limits of the Town of Scottsville .
The applicant applied for a building permit ( #86-1214 NR) on August 25,
1986 , for the construction of a new single family dwelling. At the
time of issuance of the building permit , the Zoning Department staff
did not apply the SA-Highway District setback requirement to this
parcel . This oversight has resulted in a need for a variance from
the minimum setback of one hundred fifty (150) feet to eighty-seven
(87) feet . The Zoning Department assumes responsibility for the
error and requests that the variance be granted.
Recommendation
The application should be approved.
