Dear Sirs:
This letter is to inform you that on September 29, 1987, during
the regular meeting of the Albemarle County Board of Zoning
Appeals, your application for VA-87-60 was approved.
This variance approval allows relief from Section 2 . 0 of the
Albemarle County Zoning Ordinance to allow a roof sign to be
erected which extends above the roof peak.

APPLICANT: Sachem Associates
TAX MAP/PARCEL: 61W1/02-A
ACREAGE: 6.67 Acres
ZONING: C-1 (Commercial)
LOCATION: North side of Whitewood Road, ± . 1 mile east of its
intersection with Route 743.
The applicant seeks a variance from Sections 3.0 and 4. 15.3 .6 of the
Albemarle County Zoning Ordinance . This section, pertaining to
definitions , states:
"2.0 Definitions
Sign , roof : Any sign so erected or affixed to a building
wholly upon the roof of a building of any sign that projects
above the intersection of the roof decking and wall face or
any sign extending above the eave or parapet shall be
deemed a roof sign•
4.15. 3 .6 Commercial (C-1) and Commerical Office (CO)
Business Signs, Roof : Provided: (a) signs shall in no
manner be illuminated; (b) the aggregate area of all
signs for any establishment shall not exceed fifty (50)
square feet ; (c) sign shall be in vertical plane; (d) no
portion of sign shall exceed thirty (30) feet in height
above ground level nor project above the roof peak,
including mansard and fake mansard roofs . On a parapet
wall , sign shall not project above the parapet wall ;
(e) no more than three (3) signs , including roof signs ,
shall be permitted for any establishment . "
The applicant proposes to erect an eighteen (18) square foot roof sign.
The sign is to be placed on the highest portion of the roof . The
Zoning Administrator has determined that the portion of the roof where
the sign is to be located is not an integral part of the roof structure .
Due to this determination, the proposed location of the sign places
it above the peak of the roof , thereby causing a need for a variance.
Recommendation
The application should be denied for cause:
1) The applicant has not provided evidence that a strict application
of the ordinance would produce a clearly demonstrable hardship
approaching confiscation as distinguished from a special privilege
or convenience .
2) The applicant has not demonstrated that the perceived hardship
is unique to his property in contradistinction to other properties
in the same zoning district and general vicinity.

3) The applicant has not demonstrated that the authorization of the
variance will not be of substantial detriment to the adjacent
properties or that the character of the district will not be
altered.
