Dear Sirs:
In response to the staff report recommendations to deny our request for a
zoning variance, we respectfully submit the following information:
I. "The applicant has not provided sufficient evidence to show . . .
a clearly demonstrable hardship . . ."
Our house was located as it is on the building lot because of the
unusual lay of the land. The positioning of the house on the lot
was done with careful consideration and planning and was really a-
bout the only way the house could have been located. (Please see
plat #1.) Although within legal limits, this placed the northwest
end of the house near the property sideline (20') in question.
Although we have a front and because
entrance, we, as well as visitors,
always use the side entranceetoof its convenience. When we en-
closed the room, we hoped to'use tiffs entrance as the main access to
the house. Because of the way the door had to be installed, however,
the steps do not line up with the door entry and are of no use. We
hope to incorporate the deck in question as our access to the patio
door as well as a means of increasing our leisure space and enhancing

• the value of our property. At present, we are using temporary steps
made from 2 x 4's. (See photo '-`l. ) The proposed deck would, in (Du-
opinion, tie in the new room, the entrance, and the additional out-
side leisure space very nicely.
II. Regarding recommendation r2 (as well as part of #I) , "The applicant
has not demonstrated that .
the hardship is unique to his proper-
ty "
We feel that our situation is unique for the following reasons:
1) Due to the lay of the land, the side entrance is one of only two
fairly level areas surrounding the house. (See photos -1 & #2)
The other area is the back yard, but this access is unsuitable
because:
a)The sidewalk would be in the way of a deck (See photo 2.)
b)There is no door into the house from the back. A door cut to
the new roan from the back would have to pass through a not so
picturesque laundry room. Any other access from the back would
have to pass through a bedroom, dining room, or kitchen and would
not tie in with the new room a all.

red oak would alter any deck plans
c)Addition of a deck on the back would be in greater violation of
section 12.3 than the proposed deck plan. (Side property setback
line.)

2) A deck on the east side would be virtually impossible, because:
a)the lamx3 is very steep
b)there is no door
c)access would have to be through one of two bedrooms (See photo 43)
3) Addition of the deck in the front of the house would be in greater
violation of the scenic highway setback regulations (See photo 41)
as well as, in our opinion, detracting from the overall looks of the
house, requiring more lumber (the deck would require much longer
timers to level it) and necessitating the cutting of several trees
and shrubs. (See photo 2)
4) Unaware that our proposed deck would in any way cause a problem, we
spent approximately $200.00 last winter for removal of a large red
oak in preparation for starting the deck in the spring (See stump,
photo 1.)
Ill. In response to recommendation If 3, we have talked at length with our
neighbors and none of them find any problems whatsoever with our plans
(see letters) . In fact, all have encouraged our plans to enhance the
value of our property.
In summary, we feel that from a logistical and financially feasible stand-
point, our proposed request is the only reasonable choice. Furthermore, we have
been encouraged by our neighbors and even offered assistance by them. We are
well screened from route 20 by an abundance of trees and shrubs including several
evergreens. These make even seeing the proposed deck virtually impossible from
the highway (see photos 1, 4, 5, and 6) . If, however, the variance is approved,
we plan to plant several more trees and shrubs on the front and sides of the pro-
perty to add to the blending and attractiveness of the deck.
