Brackens , General Manager Farmington Country Club One Country Club Circle Charlottesville , VA 22901 Re : Tennis Courts/Warner Wood Lease Dear Jim: You have requested my opinion as to the duration of the July 18 , 1946 lease between Warner Wood and Farmington, Incorporated , which is recorded in the Clerk ' s Office of the Circuit Court of Albemarle County in Deed Book 271 , page 147 . The lease does not have a definite duration ; however , its maximum potential duration is 99 years . The lease provides that it shall remain in effect so long as a descendant of Warner Wood is a member of the Club. Such descendant is entitled to a life membership, and this is payment for the lease. The lease further provides that if there are no living direct descendants of Warner Wood, then the lease will continue for an additional term of 99 years at an annual rental of $1 . 00 . The use of the property covered by the lease is "tennis and allied activities . " If this use should cease , then the lease terminates. The lease was assigned to Farmington Country Club by Farmington , Incorporated. The assignment is contained in the deed by which Farmington , Incorporated conveyed the Farmington property to Farmington Country Club. It is my understanding that the Club may use a portion of the property covered by the Warner Wood lease for the construction of a permanent facility housing certain of the tennis courts .
