This variance approval allows relief from Section 4 . 6. 3 . 2 of the Albemarle County Zoning Ordinance to reduce the required setback from an access easement from sixty (60) feet to one (1) foot. Shifflett TAX MAP/PARCEL: 15/12 ACREAGE: 17.32 ZONING: RA (Rural Areas) LOCATION: east side of Rt 810, ± 1 mile north of its intersection with Rt 668 The applicant seeks a variance from Section 4.6. 3 .2 of the Albemarle County Zoning Ordinance, which states: "4.6. 3 Lots , yards adjacent to street 4.6. 3.2 Other yards adjacent to streets shall have a minimum width or depth, as the case may be , of eighty (80) percent of the minimum front yard depth required in the district in which the lot is located. This provision shall apply to lots in the RA and Residential districts only. " The applicant has conveyed a three (3 .0) acre parcel to a sibling ' through the family division section of the Subdivision Ordinance and is required to provide a thirty (30) foot wide access easement to the new parcel . The applicant desires to utilize the existing driveway as the access easement and states that the topography of the property would make relocation of the access easement difficult . In an effort to designate the existing driveway as the access easement , the appli- cant requests a variance from the required setback from the minimum measurement of sixty (60) feet to one (1) foot . Recommendation The application should be approved for cause: 1) In viewing the property, it does appear that the topographical features would make relocation of the access easement difficult . The staff therefore believes that the applicant does have a hardship. One alternative to eliminating the need for the variance would be to relocate the mobile home so as to comply with the Zoning Ordinance setback requirement . The staff would not support this alternative and believes the granting of the variance is justifiable. 2) The applicant ' s hardship is unique to this property and is not generally shared by other properties in the same zoning district and/or general vicinity. 3) The granting of the applicant ' s request will not be of substantial detriment to the adjacent properties nor will the character of the district be altered.
