Dear Mr. & Mrs. Stump:
This letter is to inform you that on December 8 , 1987, during
the regular meeting of the Albemarle County Board of Zoning
Appeals, that your application for VA-87-78 was approved.
This variance approval allows relief from Section 6. 5. 01 of
the Albemarle County Zoning Ordinance to reduce the side yard
measurement from the minimum requirement of twenty-five (25)
feet to eight (8) feet to allow construction of a residential
addition.

LOCATION: West side of Route 676 , ± .3 miles north of its
intersection.. with Route 677
The applicant seeks a variance from Section 6. 5.01 of the Albemarle
County Zoning Ordinance . This section states:
"6. 5 - Non-conforming Lots
6. 5.01 In the case of any subdivision which was approved
pursuant to Chapter 18 of the County Code prior to
the adoption of this ordinance and which was of record
at the time of the adoption hereof , the rear, side and
front yard setback regulations of the Zoning Ordinance
in effect at the time of such approval shall apply to
all lots within such subdivision. "
The applicant ' s property was part of a subdivision which was put to
record prior to adoption of the present Zoning Ordinance. The property
was previously zoned A-1 (Agricultural ) and as such is required to
maintain a minimum side yard measurement of twenty-five (25) feet . The
applicant proposes to construct an eleven and three tenths(11. 3) foot
by twenty-nine (29) foot addition on the south side of the dwelling and
seeks a reduction of the side yard measurement from the minimum require-
ment of twenty-five (25) feet to eight (8) feet at the closest point .
In viewing the applicant ' s plat it appears that a causing factor in the
variance request is the original placement of the dwelling in relation-
ship to the southerly property line. Due to existing floor plan of the
dwelling, it is not practical to construct the addition on the northerly
side of the dwelling. Constructing the addition on the rear of the
dwelling is not feasible due to the topographical condition (slope) of
the property. It appears that the proposed addition as presented
represents the most viable solution to the expansion of this dwelling.
RECOMMENDATION
The application should be approved for cause:
1) The applicant ' s hardship is a combination of the topography
of the property and the original placement of the dwelling
in relationship to the southerly property line.
2) The applicant ' s hardship is generally unique to this property
and not shared by most properties in the same zoning district .
3) The granting of the variance should not prove to be detrimental
to the adjacent property nor shall the character of the district
be altered.
