Box 239 Scottsville, VA 24590 Re: Board of Zoning Appeals Action VA-87-80, Tax Map 130, Parcel 25R Dear Mr. Clark: This letter is to inform you that on December 8 , 1987 , during the regular meeting of the Albemarle County Board of Zoning Appeals, the Board ruled to approve your application with the conditions that the sign face not exceed 15 square feet and that the variance be granted to the church property. This variance approval allows relief from Sections 4 . 15 . 3 . 1 and 30. 5. 6. 2 . 1 of the Albemarle County Zoning Ordinance to increase the size of an identification sign from the maximum allowable area of four (4) square feet to twenty-seven (27) square feet, and to reduce the setback for a sign located in the Scenic Areas - Highway Overlay District from the minimum requirement of one-hundred fifty (150) feet to ten (10) feet. Burgess, Jr. Zoning Administrator CWB,jr/st cc: Reading File VA-87-80 S-87-94 STAFF REPORT - VA-87-80 APPLICANT: Calvary Baptist Church TAX MAP/PARCEL: 120/25R ACREAGE: 5 ACRES ZONING: RA (RURAL AREAS) LOCATION: South side of Rt 20 South, approximately 1 mile north of the intersection of Rt 726 and Rt 20 The applicant requests relief from Sections 4 . 15. 3 . 1 and 30.5. 6.2 . 1 of the County Zoning Ordinance. Sections 4. 15. 3 . 1 and 30. 5. 6.2 . 1 states: 4 . 15. 3 . 1 Identification Signs: Provided (a) not more than four (4) square feet in area; (b) not more than two (2) on any lot or premises. 30. 5. 6. 2 SA Highways 30. 5. 6. 2 . 1 No buildings or structures other than necessary accessory appurtenant fences and/or walls, except as here- after provided in the case of certain signs, shall be con- structed within any SA-highways overlay district. The applicant's property is located adjacent to the Scottsville Elementary School approximately one (1) mile north of the Rt 726 and Rt 20 South intersection. The highway right-of-way width for Route 20 South at the location of the applicant's property is a minimum of 110 feet, but does vary at portions north and south of that vicinity. Should a sign be located at the required 150 foot setback, the sign would not be visible from the distance of 185 feet from pavement edge. Certain signs such as subdivision, locational, directional , business wall, etc. are allowed to be located within 50 feet of the road right-of-way, but not within the required front yard of the underlying district. In this specific case the setback would have to be 75 feet, which again requires a sign to be approximately 110+ feet from the pavement edge. The Staff is of the opinion that a visual hardship exist, coupled with the sloping topography of the front portion of the applicant's property in relation to the adjoining properties elevation. Page 2 RECOMMENDATION The staff recommends approval of the setback portion of this variance, and a condition that the actual sign face not exceed fifteen (15) square feet aggregate area. INFORMATION The Board of Zoning Appeals granted a variance to the Albemarle County School Board in April, 1981 to locate a freestanding sign five (5) feet from the road right-of-way, a variance of 145 feet. on property known as county tax map 130, parcel 25P.
