Dear Mr. & Mrs. Hubbard:
This letter is to inform you that on January 12 , 1988, during
the regular meeting of the Albemarle County Board of Zoning
Appeals, that your application for VA-87-84 was approved.
This variance approval allows relief from Sections 4 . 6 . 3 . 2
and 10.4 of the Albemarle County Zoning Ordinance to reduce
the side yard setback from sixty (60) feet to fifty (50) feet
and to reduce the minimum lot size from two (2) acres to one
and five-tenths (1. 5) acres to allow construction of a single
family dwelling.

LOCATION: 100 Cavalier Drive in the Colthurst Farm
Subdivision
The applicant seeks a variance from Sections 4 . 6. 3 . 2 and 10 . 4 of
the Albemarle County Zoning Ordinance. These sections state:
"4 . 6. 3 . 2 Other yards adjacent to streets shall have a minimum
width or depth, as the case may be, of eighty (80) percent of
the minimum front yard depth required in the district in which
the lot is located. . . "
"10. 4 Area and Bulk Regulations
Minimum lot size 2 . 0 acres. . . "
The applicant at present has a non-conforming parcel containing
one and forty eight hundreths (1 . 48) acres and desires to add
a one thousand (1, 000) square foot well lot. In so doing,
the applicant loses the non-conforming status of the property
and in the opinion of the Zoning Administrator, must then comply
with the requirements of the present Zoning Ordinance.
The applicant requests a variance of minimum lot size from two
(2) acres to one and five tenths (1. 5) acres and to reduce the
setback from a side street from sixty (60) feet to fifty (50)
feet, to allow construction of a single family dwelling.
RECOMMENDATION
The application should be approved.
