LANKFORD, her husband, (Grantors) and GRADY A. HUBBARD and GAIL E . HUBBARD, husband and wife (Grantees) , whose address is 104 Cavalier Drive , Colthurst Farm, Charlottesville , Virginia. W I T N E S S E T H : THAT for and in consideration of the sum of Ten Dollars ($10 . 00) cash in hand paid and other good and valuable consideration the receipt and sufficiency of which are hereby acknowledged, Grantors , subject to the matters hereinafter set forth, hereby grant and convey with GENERAL WARRANTY and ENGLISH COVENANTS OF TITLE to Grantees , as tenants by the entireties with the right of survivorship as at common law, the following described real estate: TRACT NO. 1 All that certain lot or parcel of land with appurtenances thereto pertaining , situated in Albemarle County , Virginia , fronting on Cavalier Drive and designated as Lot 1 , Block D , of Colthurst Farm Subdivision on plat of 0. R. Randolph dated April 14 , 1958 , revised December 11 , 1958 of record in the Clerk' s Office of the Circuit Court of Albemarle County, Virginia , in Deed, Book 391 , page 461 , being in all respects the same property which was conveyed to Florence Fleet Lankford by deed of John Stewart Battle , Jr. , Executor of the Estate of Betty Sue Jessup , deceased , dated October 28 , 1977 and recorded in the said Clerk' s Office in Deed Book 640 , page 241 . Grantors further GRANT and CONVEY unto Grantees as an appurtenance to said Tract No. 1 , the nonexclusive right-of-way over the roads of Colthurst Farm Subdivision. TRACT NO. 2 All that ,certain lot or parcel of land situated in Albemarle County, Virginia, designated as "well Lot No. 1" in Block D, as shown on a plat of Colthurst Farm Subdivision made by O. R. Randolph dated April 14, 1958 , and recorded in the Clerk' s Office of the Circuit Court of Albemarle County, Virginia, in Deed Book 340 , page 423, and which is more particularly described as follows: Beginning at a point which is in the western line of Colthurst Drive and which is the sourtheast corner of Block D; thence from said point .of beginning and - along the western line of Colthurst Drive, North 1 degree 19 ' West 100 feet to a point; thence North 85 degrees 39 ' West 100 feet to a point; thence South 1 degree 19 ' East 100 feet to a point; in the southern line of said Block D; thence along the said south line, South 85 degrees 39 ' East 100 feet to the point of beginning, being in all respects the same property which was conveyed to Florence Fleet Lankford by deed of John Stewart Battle, Jr. , Executor of the Estate of Betty Sue Jessup, deceased, dated October 28 , 1977 and recorded in the said Clerk' s Office in Deed Book 640 , page 239 . By their acceptance of this deed, Grantees covenant and agree that. in the event they receive a bona fide offer to sell all or any portion of the property herein conveyed (the "Offered Property") which offer they intend to accept (the "Offer") , Grantors shall have a right of first refusal to repurchase the Offered Property upon the same terms and conditions as the Offer. Grantees shall notify Grantors of any such Offer by written notice, sent by certified mail return receipt requested to the last known residential address of Grantors. Grantors shall have fifteen (15) days after such mailing is received by Grantors in which to notify Grantees of their intent to exercise the right to repurchase the Offered Property. Grantors agree that, in the event that they decline to exercise the right to repurchase the Offered Property they will execute all documents necessary to release such right. This right to repurchase is a right personal to Grantors and may not be assigned or transferred by Grantors. This conveyance is made subject to all recorded easements, conditions, restrictions and agreements as they may lawfully apply to the real estate hereby conveyed or any part thereof. -2- • WITNESS the following signatures and seals.
