Benjamin Dick, Esquire 421 Park Street, Suite #2 Charlottesville, VA 22901 Re: Board of Zoning Appeals Action VA-87-86, Tax Map 32, Parcel 22I Dear Mr. Dick: This letter is to inform you that on January 12 , 1988 , during the regular meeting of the Albemarle County Board of Zoning Appeals, that your application for VA-87-86 was approved with the following conditions: 1) Health Department approval of the minimum requirement of a 50 percent reserve (back-up) drainfield area for system/s to serve the additional units or a maximum of 26 units. 2) The applicant be required to connect to public sewer when available. 3) An opaque type fence to be erected along the north property line, and a minimum of one (1) row of white pines (6 feet) in height to be planted parallel to the fence. Benjamin Dick VA-87-86 Page 2 This variance approval allows relief from Section 4 . 1 . 2 of the Albemarle County Zoning Ordinance to reduce the parcel area per dwelling unit from forty thousand (40, 000) square feet to six thousand one hundred seventy-five (6175) square feet to allow expansion of a mobile home park. This section states: "4 . 0 General Regulations 4 . 1. 2 For a parcel served by either a central water supply or a central sewer system, there shall be provided a minimum area of forty thousand (40, 000) square feet per commercial or industrial establishment or per dwelling unit as the case may be. " The applicant currently has a owner/operated mobile home park with 72 units. A proposal is to add 26 additional lots for units to be located on in the park. Reduction of the required lot area is requested by the applicant because the park is not served by public sewer. The applicant would agree to mandatory hookup to public sewer when the service area is enlarged and/or the service line extended. Property that bounds the area north of the expansion area is R-1, Residential and PD-IP Planned Development Industrial Park to the western line. CORRECTED COPY Staff Report - VA-87-86 Ray Beard/Cedar Hill Trailer Park Page 2 RECOMMENDATION The application should be denied for cause: 1) The applicant has not provided evidence that a strict application of the ordinance would produce a clearly demonstrable hardship approaching confiscation as distinguished from a special privilege or convenience. 2) The applicant has not demonstrated that the perceived hardship is unique to his property in contradistinction to other properties in the same zoning district and general vicinity. 3) The applicant has not demonstrated that the authorization of the variance will not be of substantial detriment to the adjacent properties or that the character of the district will be altered.
