This section, pertaining to business signs, states: "4 . 15 SIGNS 4. 15.3 .7 Highway Commercial (HC) ; Business Signs, Free-standing or Projecting: Provided: (a) if illuminated, no moving, flashing, blinking, color- changing or exposed, bare or uncovered neon illumination or lighting; (b) the aggregate area of such signs shall not exceed (100) square feet; . . . . " The applicant proposes to increase the amount of free-standing signage from the existing 138 square feet to 158 square feet. The maximum aggregate area of free-standing signage allowed by the Zoning Ordinance is 100 square feet. RECOMMENDATION The application should be denied for cause: 1. The applicant has not provided sufficient evidence to show that a strict application of the Zoning Ordinance would produce a clearly demonstrable hardship approaching con- fiscation as distinguished from a special privilege or convenience. 2 . The applicant has not demonstrated that the perceived hard- ship is unique to his property in contradistinction to other properties in the same zoning district and general vicinity. The requirement the applicant seeks relief from is shared uniformly by all properties zoned Highway Commer- cial. 3 . The applicant has not provided evidence to demonstrate that the authorization of the variance will not be of substantial detriment to the adjacent properties or that the character of the district will be altered. Burgess, Jr. C(,vV, Zoning Administrator RE: Review of VA-87-67 DATE: November 28, 1988 On November 10, 1987, the Board of Zoning Appeals approved the above referenced variance which allowed the applicant (Pantop's Texaco) to erect an additional twenty (20) square feet of freestanding signage. The applicant stated that the additional signage was needed to identify the National Car Rental business which is located on the same property as the Texaco Service Station. The Board of Zoning Appeal's approved the requested variance for one (1) year, with the stipulation that the variance be reviewed at the end of that time period. The review of VA-87-67 will occur at the regularly scheduled Board of Zoning Appeals meeting to be held on December 13 , 1988 . For your convenience I have attached a copy of the variance application, the staff report, and the pertinent minutes of the November 10, 1987 meeting. MINUTES OF November 10, 1987 The Albemarle County Board of Zoning Appeals held a regular meeting on November 10, 1987, in Meeting Room #7 on the Second Floor of the County Office• Building, 401 McIntire Road, Charlottesville, Virginia. Members present were Carl Van Fossen, William Roberson, Jacquelyn Huckle, and Max C. Kennedy, Chairman. Present from the Zoning Department were Charles W. Burgess, Jr. , Zoning Administrator; Andrew D. Evans, Deputy Zoning Administrator; and Sharon Taylor, Recording Secretary. George R. St. John, County Attorney, was present. As a quorum was established, the meeting convened at 3 : 00 p.m. Mr. Kennedy stated that anyone aggrieved by a decision of the Board Could appeal the decision to the Circuit Court of Albemarle County within thirty days of the decision. The first application before the Board was VA-87-67 , Leased Stations, which was deferred from the previous meeting. Mr. E ans stated that Mr. Crenshaw and himself had come to a consensu on the actual measurements of the signs. He stated that the o ly difference he found was when they approved the sign for M . Crenshaw it was supposed to be a 4 ' X 6' or 24 square foot sign, Ibut they actually came up with a measurement of 17 . 5 square foot. He stated that he was allowed to replace it back since they had approved a 24 square foot sign for National Car Rental. He stated that most of the other signs were the same, which came up to the same figure of 131. 5 square feet total area. Mr. Kennedy asked if he was still trying to go from 138 to 158 square feet? Mr. Evans stated that it would be 6. 5 square feet less. Mr. Crenshaw was present to speak for the application. He stated that he operated National Car Rental and Pantops Texaco. He stated that he planned to take down the 17 . 5 square foot sign and put up a 40 square foot sign in its place. Mr. Crenshaw stated that was correct. Frank Aurelio, representative of National Car Rental, was present to explain that they were going through a logo change, and that there were signs on hold all over the country. He stated that the existing sign was not as visible as the sign that was prginally ordered for this location. He stated that they had a sign already made to erect. Mr. Roberson asked what would happen to this sign once the new logo was adopted? Mr. Aurelio stated that the proposed sign would be changed once the new logo was adopted. He made a suggestion to the Board that if t ey were allowed to put up this particular sign that when the new s 'gn was erected it- would be the correct footage allowed. He asked ' f they would give them one year from the date the sign was erect d. The hairman invited public comment. Ther being no further public comment, the matter was placed before th Board. Mr. oberson stated that he could go along with this for a period of one year with the stipulation that there would be no roof or w 11 signs that he may be entitled to under the law, and take a lark at it in a year to see what the situation was. Mr. Ev4ns stated, that, they would actually be giving him 22 . 5 square feet. ' Mr. Roberson made a motion that the variance be granted for • a period of one year at which time they would review the situation, with the stipulation that he forfeit any wall or roof signs that he may be entitled to. However, at this time, National Car Rental is undergoing an identity change and all signage has been put on hold pending the outcome of this chango . The only product that Persona has in stock or is authorized to fabricate for National Car Rental would be the 5' x 8' at this t. 'e.
