Rosden TAX MAP/PARCEL: 60G/19 ACREAGE: 4 .5 acres ZONING: RA (Rural Areas) LOCATION: 1505 London Road (Inglecress Subdivision) The applic nt seeks a variance from Section 10. 4 of the Albemarle County Zon'ng Ordinance. This Section states: "10.4 AREA AND BULK REGULATIONS Yards, minimum: Front 75 feet Side 25 feet . . . . " The applicalnt proposes to construct a new single-family dwelling and seeks a reduction of the front setback measurement from the minimum requirement of seventy-five (75) feet to fifty (50) feet, and to reduce the side yard setback measurement from the minimum requiremen of twenty-five (25) feet to fifteen (15) feet. The applicant ites the topographical conditions (slope) of the pro- perty as t e causing factor for the variance request. The proposed d elling measures thirty-five (35) feet by one hundred ten (110) feet and could be situated on the property on a relatively flat area. The problem in so doing is that the appli- cant would not have any usable rear yard area due to the slope of the property. It appears that the reasonable use of the appli- cant's property can best be served through the granting of the requested Vlariance. RECOMMENDA ION The application should be approved for cause: 1) The applicant has demonstrated that the topographical condi- tions of the property have created a hardship in the reason- able use of said property. 2) The hardship the applicant has presented is unique to this property in that other properties in the general vicinity contains building sites that are not immediately adjacent to areas of severe topographical variation. 3) The granting of the applicant's request will not be of detri- ment to the adjacent properties, nor will the character of the the zoning district be altered.
