Charles W . Burgess , Jr . Zoning Administrator County of Albemarle 401 McIntire Road Charlottesville , Virginia 22901 -4596 Dear Mr . Burgess : Regarding the variance requested by Mr . B . G . Snow on property described on Tax Map 32E-03 , Parcel 14 , Zoned R-4 , File #VA-88--3 , I am opposed to reducing the setback from ten feet to three feet for the following reasons : 1 . The construction of a deck is not any kind of a relief from hardship or to relieve a property owner of a problem he has unwittingly ( e . g . mistake by a surveyor or contractor ) already gotten into . This is merely a request by a property owner to change a setback requirement , which is already a minimum ( 10 ' ) , for the purpose of a future construction . 2 . There are over 200 lots in Camelot ; and if this variance was granted , a precedent would be set ; so every lot owner would be equally entitled to similar variances . To my knowledge there are no similar type variances in Camelot . 3 . As the developer of Section III , Camelot , I have been very careful to build houses leaving as much sideyard setback as possible ; and in no case have I approved plans that would infringe on the setback requirement . I also never contemplated such a request because I knew the County would not grant it . 4 . I still own 13 lots ( as well as the adjoining Lot 15 ) ; and if this variance is granted , the builders on each of these lots would have the right to apply for similar variances , as well as all the other lot owners ; and Camelot would lose a lot of its character and appeal .
