Anyone aggrieved by a decision made by the Board can appeal the decision to the Circuit Court of Albemarle County within thirty (30) days of the decision. Burgess, Jr. Zoning Administrator CWB,Jr/st cc: VA-87-77 STAFF REPORT - VA-87-77 OWNER: Berean Baptist Church TAX MAP/PARCEL: 76/51B ACREAGE: 4 . 0 acres ZONING: R-1, Residential LOCATION: West side of State Route 631, . 4 mile south of the intersection of Rt. 781 and Rt. 631 The Berean Baptist Church requests relief from Section 4 . 15. 3 . 2 of the Albemarle County Zoning Ordinance. "4 . 15 SIGNS 4 . 15. 3 . 2 states: "Identification Signs: Provided: (a) not more than two (2) square feet in area; and (b) not more than one (1) on any lot or premises. " The applicant proposes to have a brick base constructed and a 5 foot by 10 foot slate sign face mounted to the base. Overall base diminsions will be approximately 12 foot in length by 8 foot high. Sight distance for a motorist traveling south on Route 631 is adequate to see the sign at the proposed location. A motorist traveling north on Route 631 does not have the same visible sight distance due to the curvature of the road combined with the approximate travel speed of 40 to 45 miles per hour. The Board of Zoning Appeals granted a variance in October, 1982 , to a previous occupant (Grace Baptist Church) to allow a free- standing sign with an aggregate area of six (6) square feet, a variance of four (4) square feet. The Board of Zoning Appeals granted a variance to Kingdom Hall of Jehovah Witnesses in August, 1982 to allow a five (5) square foot freestanding sign, a variance of three (3) square feet. They also allowed the sign to be located one (1) foot from the road right-of-way. The Kingdom Hall property is across the road from the Berean Church location. RECOMMENDATION The application should be denied for cause: VA-87-77 Berean Baptist Church Staff Report Page 2 1) The applicant has not demonstrated that his perceived hardship is unique to his property in contradistinction to other properties in the same zoning district and general vicinity. The same requirement is shared by all other properties zoned R-1, Residential. 2) Sufficient evidence to show that a strict application of the Zoning Ordinance would produce a clearly demonstrable hard- ship approaching confiscation as distinguished from a special priviledge or convenience has not been provided. 3) The applicant has not provided evidence to demonstrate that the authorization of the variance will not be of substantial detriment to the adjacent properties or that the character of the district will not be altered.
