Hi Andy,
I apologize for the delay in my response.
I guess my questions can be simplified as this:
I'm not entirely sure that previous plats correctly identified the "right-of-way." I don't think it's actually a road
or right-of-way that was required by the County for any regulatory purpose. I believe that at most, it was just a
private access easement, and possibly not even a private easement at all. It could have just been a note on a
previous plat that identified it as a feature on the properties, and the subsequent plats misinterpreted the note
as meaning that it was a "right-of-way.". However, I can't say that with 100% certainty. Is it our job or the
surveyors responsibility for making that determination?
If it is a private easement, do we need to get any sort of documentation from the surveyor proving that all
parties that are entitled to the easement agree to vacate it? Or, can we just allow it to be vacated since the
surveyor and property owner are signing the plat?
o If it is an actual easement, my concern is that it is shown on some plats going through an adjacent
property that is not part of the current plat's boundary line adjustment. Therefore, those owners don't
know the easement is proposed to be vacated with this current application. I don't want us to get in
trouble if we approve the plat and the neighboring owner later finds out that this easement was vacated
without their consent.

Hi James,
Attached are the materials associated with this application that I spoke with you about a moment ago.
This is a Boundary Line Adjustment plat that also proposes to vacate a right-of-way/easement that has been identified
on previously recorded plats associated with these properties. There is a dirt road within the boundaries of the right-of-
way/easement. They have prepared a Deed of Vacation to go along with the plat.
They also submitted a Deed of Correction which seems to explain that some of these previous plats misidentified the
owners rights or whatever that pertained to this road/right-of-way/easement. They want to vacate the entire length of
whatever it really is across all of the subject properties.
I only have an electronic version of the plat, but I can get the applicant to bring me a hard copy if Greg needs it for the
review.

THIS DEED OF CORRECTION, which is exempt from recordation taxes pursuant to
Virginia Code §58.1-810, made this day of June, 2019, by and between S-V
ASSCOCIATES, a Virginia general partnership, hereinafter sometimes referred to as the
Grantor, and UPTOWN VILLAGE, LLC, whose address is P.O. Box 5548, Charlottesville, VA

TERMINATE and ABANDON unto the Grantee all of its right, title and interest in and to the
above -described Dirt Road as an easement or other appurtenance to the above -described
Benefitted Parcels.
The Benefitted Parcels on Schedule A are a portion of the property conveyed by Deed
dated November 16, 2006 from M. Clifton McClure and Robert M. Callaghan, Trustees of the
NYC Land Trust u/a dated May 4, 1986, One -Ninth, LLC, a Virginia limited liability company,
S-V Associates, a Virginia general partnership, M. Clifton McClure and Robert M. Callaghan,
Trustees of the Atlantic Land Trust under agreement dated 21, 2000, and River Heights
Associates Limited Partnership, a Connecticut Limited Partnership, to Uptown Village, LLC
which deed is recorded in the Clerk's Office of the Circuit Court of Albemarle County, Virginia
