HomeMy WebLinkAboutSUB201900092 Review Comments Appeal to BOS 2019-06-27 (2)M t'IRGINZA County of Albemarle Department of Community Development 401 McIntire Road, Charlottesville, VA, 22902 434-296-5832 Memorandum To: Paul Huber From: Christopher Perez, Senior Planner Division: Planning Date: June 27, 2019 Subject: SUB2019-92 Lighthouse Instruments — Easement Plat Various easements on ASTEC Partnership TMP 77-9A The County of Albemarle Planning Division will grant or recommend approval of the plat referenced above once the following comments have been addressed: [Each comment is preceded by the applicable reference, which is to the Subdivision/Zoning Ordinances unless otherwise specified.] 1. [Recommendation] As currently proposed there are four plats each with multiple pages all depicting various portions of the necessary easements over multiple properties. This methodology of platting the various required easements increases the likelihood of error and is difficult to review. In the next submittal, please include a locator map, as an inset map, to indicate which areas of the development are shown by each sheet. 2. [14-302(B)5, 30.7.4(b)] Preserved Slopes. The private utility easement for the sanitary sewer lateral is depicted through preserved slopes. This use is not permitted in preserved slopes, revise the easement and the improvement to be outside of the preserved slopes. Please coordinate with ACSA and Jonathan Showalter of Timmons Group. 3. [14-302(A)5] Public Easements. Depict, label, and dimension the existing sewer easement on TMP 77-9A. Also label the owner of this easement. 4. [14-302(A)3] Existing or platted streets. County records depict TMP 77-9A extending to the centerline of the road. Ensure the lot line and right-of-way are accurately depicted. If this is a prescriptive right-of-way ensure the water easement and gas easement are provided throughout. 5. [14-302(A)11] Instrument creating property proposed for subdivision. The recordation information provided on the easement plat for TMP 77-9A appears to be incorrect, DB 1369 PG 427. Revise the plan to provide the correct recordation information. 6. [14-302(A)4] Private Easements. Ensure the new 20' utility easement is centered on the new water line. The proposed easement location depicted on the plat does not match the waterline depicted on the final site plan. Revise to ensure they match. 7. [14-302(A)5] Public Easements. The site plan depicts a new gas line originating on TMP 77-9A, ensure an easement is provided for the new gas line. 8. [14-302(A)5] Public Easements. Provide the new gas line with an easement throughout the prescriptive right-of-way for Avon Court. 9. [14-303(L)] Drainage Easement. Ensure the drainage easement depicted on TMP 77-9A is large enough to encompass the entire drainage facility. Please relocate the dimension label of "25.91" from the easement to clearly depict the easement. 10. [14-302(A)5] Public Easements. Revise note #6 as follows: "This plat hereby dedicates to public use the temporary construction easements, sight distance easements, ACSA waterline easements, drainage easements shown hereon. " This note shall reference the correct easement labels if they are modified. 11. [14-302(A)5] Public Easements. For all proposed easements provide the name of the public owner of record. 12. [14-302(A)3] Existing platted streets. Label the existing portion of Avon Court as State Route 1101. 13. [14-302(A)4, 14-302(A)5] Easements. Dimension all easements. 14. [14-302(A)2] Vicinity Map. Revise the vicinity map to be 1" = 2,000'. 15. [14-302(B)10] Stream Buffers. Depict and label the 100' stream buffer. Provide the following note on the plat: "The stream buffer(s) shown hereon shall be managed in accordance with the Albemarle County Water Protection Ordinance. " 16. [14-303(0)] Signature Panel. Revise the approval block to: `Agent for the Board of Supervisors ". 17. [14-302(B)8] Yards. Revise the setbacks as follows: Front: Minimum — 10 feet from the right-of-way or the exterior edge of the sidewalk if the sidewalk is outside of the right-of-way; for off-street parking or loading spaces, 10 feet from any public street right-of-way. Maximum — none Side: Minimum — primary structure shall be constructed and separated in accordance with the current edition of the Building Code. Maximum — none Rear: Minimum — primary structure shall be constructed and separated in accordance with the current edition of the Building Code. Maximum — none 18. [14-302(B)(5)] Zoning Classification. Under the zoning of the property list the following overlay district: - Steep slopes: managed slopes and preserved slopes overlay district - Entrance Corridor overlay district - State and Federal dam inundation zones - Airport Impact Area 19. [14-302(B)(1)] General Information. Provide the date of the last revision. 20. [14-433, 14-303L, 14-317, 14-431, 14-428, 14-434, 14-435, 14-435.1] The required deed of dedication and easement associated with the public drainage easements shall be approved by the County Attorney prior to final plat approval. Please submit an unsigned draft of the documents to staff and we will distribute it to the County Attorney's office for review/approval. See attached template. 21. [14-434, 14-435, 14-435.1, 14-431, 14-311, 14-4281 Multiple plats have been submitted which depict the public right- of-way dedication, associated public drainage easements, temporary construction easements, and all other required easements for the construction and use of the public road. Prior to final plat approvals, all improvements necessary for the construction, use, and maintenance of the public road shall be approved on a road plan and built or bonded pursuant to Section 14-434, 14-435, and 14-435.1 of the Subdivision Ordinance. VDOT — Adam Moore See attached approval. Engineering — David James Comments to be forwarded once received. ACSA — Richard Nelson See attached comments. Staff has provided references to provisions of Chapter 14 of the Code of the County of Albemarle. The Code is kept up to date by the County Attorney's office. The Code may found on the County Attorney's website which may be found under "Departments and Services" at Albemarle.org. In accord with the provisions of Section 14-229(B) of Chapter 14 of the Code if the developer fails to submit a revised final plat to address all of the requirements within six (6) months after the date of this letter the application shall be deemed to have been voluntarily withdrawn by the developer.
