Dear Mr. Reiss:
This letter is to inform you that on March 8, 1988, during
the regular meeting of the Albemarle County Board of Zoning
Appeals, that your application for VA-88-9 was approved as
submitted.
This variance approval allows relief from section 30. 5. 6.2 . 1
and 30. 5.7 . 2 (b) of the Albemarle County Zoning Ordinance to
reduce the setback for a free-standing sign in the Scenic Areas-
Highway District from one hundred fifty (150) feet to ten (10)
feet, to increase the number of free-standing signs allowed from
one (1) to two (2) such signs, and to increase the sign area for
free-standing signs from the maximum allowable area of eighteen
(18) square feet to twenty-seven (27) square feet.

APPLICANT: Catholic Diocese of Richmond

ZONING: RA (Rural Areas)
ACREAGE: 4 . 0 & 6.3
LOCATION: Located 100 yards southeast of the intersection
of Rt 20 and Rt 626
The applicant is seeking relief from Sections 30. 6.5. 2 . 1 and
30. 5.7.2 (b) of the Albemarle County Zoning Ordinance. These
sections state:
"30.5. 6.2 . 1 No buildings or structures other than necessary
accessory appurtenant fences and/or walls, except
as hereafter provided in the case of certain
signs, shall be constructed within any SA-Highways
Overlay District. "
"30.5.7.2 . (b) Free-standing business and projecting business
signs shall be limited to ten (10) feet in height
above grade, eighteen (18) square feet per single
sign face, and to one (1) sign per separate
highway frontage.
The applicant seeks a variance to reduce the setback for
freestanding signs in the Scenic Areas-Highway Overlay District
from the minimum requirement of one hundred-fifty (150) feet to
ten (10) feet, to increase the number of freestanding signs
allowed per highway frontage from the allowable number of one (1)
such sign to two (2) signs and to increase the allowable area of
free standing signage from the maximum of eighteen (18) square
feet to twenty-seven (27) square feet. The two (2) free standing
signs presently exist on the property. In viewing the property,
the signs are visible at a distance of approximately one hundred
(100) feet both from a northerly or southerly approach. The
causing factor in the applicant's requests is the one hundred ten
(110) foot right-of-way width.
The Board of Zoning Appeals approved a similar variance for
Calvary Baptist Church (VA-87-80) , located at tax map 130, parcel
25R, on December 8, 1987 . The specific approvals given for the
free-standing sign was to reduce the required setback to ten (10)
feet and to allow a maximum sign area of twenty-seven (27) square
feet.
RECOMMENDATION
The staff believes that due to the width of the right-of-way and
the limited visual access to the signs, that the applicant's
request should be approved.
