This variance approval allows relief from section 17 . 3 . of the Albemarle County Zoning Ordinance to reduce the rear yard measurement from the minimum requirement of twenty (20) feet to thirteen (13) feet to allow construction of an addition to a dwelling unit. If you have any questions, please contact our office. Sincerely, Charles W. Burgess, Jr. Zoning Administrator CWB,j r/st cc: VA-88-12 Inspections Department STAFF REPORT - VA-88-12 OWNER: James E. Harlow TAX MAP/PARCEL: 61B/03-Q1 ZONING: R-10 (Residential) LOCATION: Located in Townwood at 1651 Cool Spring Road The applicant seeks a variance from Section 17.3 of the Albemarle County Zoning Ordinance, which states: "17.3 Area and Bulk Regulations .Yards, minimum Rear 20 feet . . . . " The applicant proposes to construct a twelve (12) foot by twenty (20) foot addition to the rear of his townhouse unit and seeks a reduction of the rear yard setback from the minimum requirement of twenty (20) feet to thirteen (13) feet. The applicant cites the irregular configuration of the rear property line as the causing factor for the requested variance. The applicant has already received approval from the Architectural Review Committee for Townwood for the proposed addition and has obtained statements from the adjacent property owners in which he/she state they have no objection to the proposed addition. RECOMMENDATION The application should be approved: 1) In viewing the applicant's plat and the Townwood development as a whole, it becomes apparent that the irregular configuration of the rear property line does create a hardship for the applicant in the reasonable use of his property. 2) The applicant's hardship is not generally shared by other properties in the Townwood Subdivision. It appears that of one hundred sixty (160) units located in Townwood, only four (4) units share a similar hardship to that of the applicant. 3) The granting of the applicant's request will not be of substantial detriment to the adjacent properties nor will the character of the district be altered. 8A Ab J "` COUNTY OF ALBEMARLE Department of Zoning 401 McIntire Road Charlottesville, Virginia 22901-4596 (804) 296-5875 April 14, 1988 Mr. James E.
