Dear Mrs. Pollard:
This letter is to inform you that on April 12 , 1988, during
the regular meeting of the Albemarle County Board of Zoning
Appeals, the Board granted your variance request, VA-88-14,
subject to the following stipulation:
1) That when Mrs. Pollard's brother (Steve Pollard) leaves
the premises that the other house not be rented or occupied.
This variance approval allows relief from Section 10.4 of the
Albemarle County Zoning Ordinance to increase the gross density
from five-tenths ( .5) dwelling units per acre to seventy-five
hundreths ( .75) dwelling units per acre to allow construction of
a second dwelling on a parcel containing three acres.

ACREAGE: 3 . 08 acres
LOCATION: East side of Rt. 618, +/- . 6 miles north of its
intersection with Rt. 622
The applicant seeks a variance from Section 10. 4 of the Albemarle
County Zoning Ordinance, which states:
"10.4 Area and Bulk Regulations
Gross Density 0. 5 du/ac . . . "
The applicant obtained a building permit (#87-648NR) on May 22 ,
1987 for the construction of a single-family dwelling. After
construction of the new dwelling commenced, the Zoning Department
learned that a single-family dwelling already exists on the
property. The exterior of the new dwelling is complete. The
applicant now requests a variance to increase the density in the
Rural Areas District from 0. 5 dwelling units per acre to 0. 75
dwelling units per acre. The applicant's property contains
approximately three (3) acres and the Zoning Ordinance requires
a minimum lot size of two (2) acres per dwelling unit. The
applicant is unable to obtain additional property from adjacent
property owners.
RECOMMENDATION
The application should be denied for cause:
1. The applicant has not provided sufficient evidence to show
that a strict application of the Zoning Ordinance would
produce a clearly demonstrable hardship approaching con-
fiscation as distinguished from a special privilege or
convenience.
2 . The applicant has not demonstrated that the perceived
hardship is unique to his property in contradistinction to
other properties in the same zoning district and general
vicinity. The requirement the applicant seeks relief from
is shared by all properties zoned Rural Areas.
3 . The applicant has not provided evidence to demonstrate that
the authorization of the variance will not be of substantial
detriment to the adjacent properties or that the character
of the district will be altered.
