Dear Mr. Harlow:
This letter is to inform you that on April 12 , 1988, during
the regular meeting of the Albemarle County Board of Zoning
Appeals, that your application for VA-88-12 was approved as
submitted.
This variance approval allows relief from section 17 . 3 . of the
Albemarle County Zoning Ordinance to reduce the rear yard
measurement from the minimum requirement of thirteen (13) feet to
eleven (11) feet to allow construction of an addition to a
dwelling.

LOCATION: Located in Townwood at 1651 Cool Spring Road
The applicant seeks a variance from Section 17. 3 of the Albemarle
County Zoning Ordinance, which states:
"17. 3 Area and Bulk Regulations
•Yards, minimum
Rear 20 feet . . . . "
The applicant received a variance from the Board of Zoning Appeals
on March 8, 1988 (VA-88-12) , which authorized the reduction of the
rear yard setback from twenty (20) feet to thirteen (13) feet.
The applicant now desires to increase the depth of the proposed
addition two (2) feet thereby reducing the rear yard measurement
to eleven (11) feet. The increased size was suggested by the
architect designing the addition.
The applicant has already received approval from the Architectural
Review Committee for Townwood for the proposed addition and has
obtained statements from the adjacent property owners in which
he/she state they have no objection to the proposed addition.
RECOMMENDATION
The application should be approved:
1) In viewing the applicant's plat and the Townwood development
as a whole, it becomes apparent that the irregular
configuration of the rear property line does create a hardship
for the applicant in the reasonable use of his property.
2) The applicant's hardship is not generally shared by other
properties in the Townwood Subdivision. It appears that of
one hundred sixty (160) units located in Townwood, only four
(4) units share a similar hardship to that of the applicant.
3) The granting of the applicant's request will not be of
substantial detriment to the adjacent properties nor will the
character of the district be altered.
