This variance approval allows relief from Section 4 . 11. 2 . 1 of the Albemarle County Zoning Ordinance to reduce the setback for an accessory structure from the minimum requirement of six (6) feet to one (1) foot. STAFF REPORT - VA-88-22 OWNER: Nancy L. Garner TAX MAP/PARCEL: 61W2/02-I3 ZONING: R-6 (Residential) LOCATION: 1505 Minor Ridge Court The applicant seeks a variance from Section 4 .11. 2 .1 of the Albemarle County Zoning Ordinance which states: "4. 11.2 . 1 Accessory Structures If no utility or drainage easements or other easements are adversely affected, accessory structures or portions thereof may be erected no closer than six (6) feet to adjacent lot lines in the case of detached structures. . . " The applicant proposes to construct an eight (8) foot by eight (8) foot accessory structure in the rear yard of her townhouse unit and seeks a reduction of the setback measure- ment from the required six (6) foot from an adjacent lot line to five (5) feet from the rear property line and one (1) foot from the side property line. The applicant's rear yard measures twenty-two (22) feet in width and twenty-six (26) feet in depth. A five (5) foot gas easement exists on the applicant's property, running parallel to the rear property line. Similar variances were granted by the Board of Zoning Appeals on July 9, 1985, to five (5) other property owners on Minor Ridge Court. One of the previous variances (VA-85-29) was granted to 1507 Minor Ridge Court. RECOMMENDATION The zoning ordinance does not provide for any special considera- tion for accessory structures which are to be located in a town- house development. The applicant could comply with the setbacks required, but the structure would then be situated in the middle of the five hundred seventy (570) square foot rear yard. In that similar variances have been granted in the past to other properties in the development, it does not appear that the granting of this request will alter the character of the district nor adversely affect the adjacent properties. The staff believes that the variance request should be granted subject to the following: (1) Approval of the structure and location of same by the Minor Hill Townhouse Homeowners Association, and (2) subject to compliance with any applicable requirements of the Virginia Uniform Statewide Building Code
