Dear Mrs . Brittian:
R. D. Wade Builder is sending this letter in an effort to help
Mr. Hand obtain a variance for his home at lot 58 North Pines .
February of this year , we were made aware of the front setback
violation shown on the plat drawn by B. Aubrey Huffman and Associates
Ltd. dated Feb 6 , 1987 . Since the error was not brought to our
attention before closing , this creates two hardships on Mr. Hand.
1. He will be subject to penalties for the violation
under the zoning ordinance.
2. He will be unable to sell the home because of a cloud
on the title.
R. D. Wade Builder regrets the error in siting which apparently came
from not allowing for the arc in the front property line . This is
shown on the attached plat .
We believe the violation does not adversely effect the spirit of the
ordinance and from a practical standpoint has no visual effect on
this or the adjoining properties .
