This variance approval allows relief from Section 10.4 of the Albemarle County Zoning ordinance to reduce the front setback from the minimum requirement of seventy-five (75) feet to forty (40) feet to allow construction of a dwelling. If you have any questions, please contact our office. sincerely, 1 Charles W. Burgess, Jr. Zoning Administrator CWB:JR/st cc: VA-88-28 Inspections Department STAFF REPORT - VA-88-28 OWNER: APPLICANT: TAX MAP/PARCEL: ACREAGE: ZONING: LOCATION: Dabney Via David Wyant 55/96 1.38 RA (Rural Areas) South side of Route 684, east of its intersection +/- .1 mile with Route 250 The applicant seeks a variance from Section 10.4 of the Albemarle County Zoning Ordinance, which states: 1110.4 Area and Bulk Regulations Yards, minimum: Front 75 feet . . . " The applicant proposes to construct a single family dwelling on a non -conforming lot. The parcel has a lot depth of approximately one hundred (100) feet and can therefore not be used for develop- ment purposes without benefit of some spatial variance being granted. The applicant therefore seeks a reduction of the front setback from the minimum requirement of seventy-five (75) feet to forty (40) feet. RECOMMENDATION The application should be approved for cause: 1) The zoning ordinance requirements have created a hardship and hinder the applicant in the reasonable development of his property 2) The hardship the applicant has is generally unique to this property. Other non -conforming properties may experience similar circumstances. 3) The granting of the variance will not be of detriment to the adjacent properties nor will the character of the district be altered.
