This variance approval allows relief from Section 10.4 of the Albemarle County Zoning Ordinance to reduce the required front yard setback for a church addition from seventy-five (75) feet to twenty-one (21) feet. Burgess, Jr. Zoning Administrator CWB;jr/st cc: VA-88-32 STAFF REPORT - VA-88-32 APPLICANT - Oak Ridge Baptist Church TAX MAP/PARCEL - Tax Map 126, Parcel 21A ZONING - RA (Rural Areas) ACREAGE - 1. 01 LOCATION - N. W. side of State Rt 721, .7 miles north of its intersection with Rt 6 The applicant seeks a variance from Section 10.4 of the Albemarle County Zoning Ordinance, which states: "10.4 Area and Bulk Regulations • yards, minimum front. . . . 75 feet . . . " The church wishes to construct new exterior walls to replace the existing old hewed timbers, which will be located twenty one (21) feet from the road right-of-way, requiring a variance of fifty- four (54) feet. The church was constructed quite a long time ago, and its present state is in dire need of repair. In May of 1985 the Board of Zoning Appeals reviewed and approved a variance, for the church to add an addition, housing two (2) bathrooms. The variance allowed the new construction to come within twenty-three (23) feet of the road right-of-way on the front property line. The church has petitioned the Board at this time requesting that they allow reconstruction of the supporting walls which will encroach on the front property line two (2) feet beyond the '85 variance approval. The new proposed construction is prohibited as per Section 6. 2 of the County Zoning Ordinance. Work may be done on non-conforming structures, such as repairs, or replacement on non-bearing walls. RECOMMENDATION The application should be approved for cause: 1) The Zoning Ordinance requirements create a hardship and hinder the applicant from restoring the structure. 2) The hardship is not generally shared by other properties. Other non-conforming properties may experience similar circumstances. 3) The granting of the variance should not be of any detriment to the adjacent properties, nor should the character of the district be altered.
