This variance approval allows relief from Section 10.4 of the Albemarle County Zoning Ordinance to reduce the front yard setback for a mobile home from seventy-five (75) feet to thirty (30) feet. Burgess, Jr. Zoning Administrator CWB;j r/st cc: VA-88-33 Inspections Department STAFF REPORT - VA-88-33 APPLICANT: Garrett Clark TAX MAP/PARCEL: 62/12 ZONING: RA (Rural Areas) ACREAGE: 5.279 acres LOCATION: Located at 1177 Free State Road The applicant seeks a variance from Section 10.4 of the Albemarle County Zoning Ordinance, which states: "10.4 Area and Bulk Regulations .Yards, minimum Front 75 feet . . . . " The applicant proposes to locate a mobile home on his property and seeks a reduction of the front yard setback from the minimum requirement of seventy-five (75) feet to thirty (30) feet. A Special Use Permit (#SP-81-3) was approved by the Albemarle County Board of Supervisors on March 4, 1981, authorizing the placement of a mobile home on this property. The Board of Zoning Appeals granted a variance (#VA-81-04) on February 24, 1981 which reduced the front setback for a mobile home from seventy-five (75) feet to twenty-seven (27) feet. The variance was granted due to the topographical condition (slope) of the property subject to three (3) conditions. One of the conditions was that the variance was granted to the applicant only. The applicant was a Mr. Herbert E. Kaufman. The original mobile home was removed from the property approximately three (3) years ago. The present owner desires to locate a new mobile home on the property in the approximate location of the old one. In so doing the septic system and well of the old unit could be utilized. RECOMMENDATION The application should be approved for cause: 1) The applicant has demonstrated that the topographical features of the property create a hardship in the reasonable use of said property. 2) The hardship is not generally shared by other properties in the general vicinity. 3) The authorization of the variance will not be of detriment to the adjacent properties nor will the character of the district be altered.
