Dear Mr. McCauley:
This letter is to inform you that on July 26, 1988, during
the regular meeting of the Albemarle County Board of Zoning
Appeals, that your application for VA-88-37 was approved as
submitted.
This variance approval allows relief from section 10.4 of the
Albemarle County Zoning Ordinance to reduce the front yard setback
for an addition from seventy-five (75) feet to forty-four (44)
feet.

The applicant seeks a variance from Section 10.4 of the Albemarle
County Zoning Ordinance, which states:
"10.4 Area and Bulk Regulations
•Yards, minimum
front 75 feet . . . "
The applicant proposes to construct a nine (9) foot by twenty-
one (21) foot addition to an existing, non-conforming country
store and seeks a reduction of the front yard setback measure-
ment from the minimum requirement of seventy-five (75) feet
to forty-four (44) feet. The proposed addition will be to the
west side of the existing structure. A similar variance (case
#77-05) was granted by the Board of Zoning Appeals on March 8,
1977, which authorized the reduction of the front yard setback
from seventy-five (75) feet to forty-four (44) feet to enable the
construction of freezer.
No determination has yet been made as to whether the proposed
addition will necessitate additional off-street parking spaces to
be provided and henceforth whether a site development plan will be
required.
RECOMMENDATION
Based on the previous action of the Board of Zoning Appeals, the
staff recommends that the application be approved. The staff is
of the opinion that the granting of the variance will not be of
detriment to the adjacent properties nor will the character of the
district be altered.
