TAX MAP/PARCEL 59/80B ZONING: HC (Highway Commercial) ACREAGE: 1.7 LOCATION: North side of Rt 250 West, +/- . 1 mile west of its intersection with Ednam Drive The applicant is requesting relief from Section 30. 5.7. 2 of the Albemarle County Zoning Ordinance. Section 30. 5.7 .2 states: "30. 5.7 .2 Business wall signs shall be limited to twenty (20) feet in height above grade, thirty five (35) square feet per single sign face, and to one (1) sign per separate highway frontage. " The operator of Woodfin Auto Parts Business is asking that the Board review a new application, which is a reduction of the previous application reviewed and denied on February 9, 1988. Mr. Everett has condensed his proposal to have only two (2) wall signs. One (1) sign has 43 .5 square feet and the other 33 . 3 , making a total of 81.8 square feet, a variance of 46.8 square feet. The site affords average or better visual access for motorists traveling west on Route 250, and somewhat acceptable level of visibility for the east bound travelers. The pine tree>€on the west end of the property adjacent to Rt 250 does present some visual barrier for the eastern traveler. The applicant has reduced his request from the February application, but is still in conflict with the SA Highway intent. RECOMMENDATION The application should be denied for cause: 1) The applicant has not provided sufficient evidence to show that a strict application of the Zoning Ordinance would produce a demonstrable hardship approaching confiscation as distinguished from a special privilege or convenience. 2) The applicant has not demonstrated that the perceived hardship is unique to his property in contradistinction to other properties in the same zoning district and general vicinity. Everett) Tax Map 59 , Parcel 80B FROM: Andrew Evans, Deputy Zoning Administrator DATE: September 30, 1988 RE: Status The Board of Zoning Appeals denied a variance for Woodfin Used Honda Parts on their July 26, 1988 meeting. Mr. Everett submitted a drawing to the Director of Planning for approval of a sign of less than 35 sq. ft. to be located on Rt 250 West in SA Highway District. The Planning Director approved the sign drawing.
