Ryalls Re: Board of Zoning Appeals Action VA-88-45, Tax Map 79A1, Parcel B27 Dear Mr. Ryalls: This letter is to inform you that on July 26, 1988, during the regular meeting of the Albemarle County Board of Zoning Appeals, the Board granted your variance request, VA-88-45, subject to the following conditions: 1) that the existing sign and base be removed, and 2) there be external shielded lighting on the sign itself. This variance approval allows relief from Section 10.4 of the Albemarle County Zoning Ordinance to reduce the setback for a freestaning business sign from the minimum requirement of seventy-five (75) feet to one (1) foot. STAFF REPORT - VA-88-45 APPLICANT - Loyal Order of the Moose, Inc. TAX MAP/PARCEL - 79A1/B-27 ZONING - RA (Rural Areas) LOCATION - West side of Route 250, +/- .2 miles north of its intersection with Route 744 The applicant seeks a variance from Section 10.4 of the Albemarle County Zoning Ordinance, which states: "10.4 Area and Bulk Regulations yards, minimum front 75 feet . . . " The applicant proposes to erect a twenty-five (25) square foot, freestanding sign and seeks a reduction of the setback from the minimum requirement of seventy-five (75) feet to one (1) foot. A freestanding sign presently exists on the property which is located within five (5) feet of the front property line. The applicant proposes to remove the existing sign and desires to erect the new sign in a location which will maximize its visibility. The proposed sign has a height of seven (7) feet and is to be of stone and masonry construction. Recommendation The application should be denied for cause: 1) The applicant has not provided sufficient evidence to show that a strict application of the Zoning Ordinance would produce a demonstrable hardship approaching confiscation as distinguished from a special privilege or convenience. 2) The applicant has not demonstrated that the perceived hardship is unique to his property in contradistinction to other properties in the same zoning district and general vicinity. 3) The applicant has not provided evidence to demonstrate that the authorization of the variance will not be of substantial detriment to the adjacent properties or that the character of the district will not be altered.
