Dear Mr . Burgess :
Thank you for your letter of July 13 , 1988 regarding the
City's application for a zoning variance and sign permit at
the Public Works Center site on Avon Street Extended.
We are disappointed that you were unable to waive the
application fee for the variance but we have enclosed a
check for $50 . 00 .
I have also enclosed a copy of a portion of the site plan
showing the location for the proposed sign. We are
requesting that the set back from Rt . 742 be reduced from
50 feet to 11 feet and that the set back from the internal
road be reduced from 50 feet to 35 feet . The minimal set
back from Rt . 742 is due to the need to maintain one row of
trees from the approved landscape plan behind the proposed
sign.

for a sign permit and variance. An application fee of $50. 00
is required to process your variance application. Also,
the variance application did not indicate the location
of the proposed sign or amount of variance requested. This
information will be needed to process your application.

the east side of Avon Street, Extended (State Route 742) ,
consisting of 50. 863 acres, in gross and not by the acre , being
the residue of a 91 . 67 acre tract, lying to the north of
Interstate 64 and east of State Route 742 , which was conveyed to
Robert Shoffner, Trustee, by deed of Fox Brothers, Inc. , dated
June 6 , 1950, and recorded in the Clerk' s Office of the Circuit
Court of said County in Deed Book 289 , page 390 , EXCEPTING
THEREFROM the following off-conveyances:
(1) 2 .768 acres conveyed to Watson
Corporation by deed dated June 16 , 1969 ,
recorded in said Clerk' s Office in Deed book
460 , page 007; and
(2) 10. 060 acres conveyed to Charlottesville
Service Center, Inc. by deed dated February
10 , 1971 and recorded in said Clerk' s Office
in Deed Book 484 , page 555; and
(3) 4 . 025 acres conveyed to Coyne and Delany

Attached hereto is a plat showing the subject property made
by Gloeckner, Lincoln & Osborne, Inc. , dated September 25 , 1986
titled "Plat Showing Survey of 50 . 87 Acres of Land The Property
of Noemi G.M. de Shoffner, et al Located on Interstate 64 , State
Route 742 And the South Bank of Moores Creek Adjoining the City
of Charlottesville, Scottsville District, Albemarle County,
Virginia" .
The subject property is conveyed together with the
following non-exclusive easements which shall be appurtenant to
the 50. 863± acre tract conveyed hereby (herein the "subject
property" ) and shall run with the land , to-wit:
(1) a non-exclusive easement and right to hook into,
upgrade and increase the size of that sanitary sewer manhole
shown on a plat made by R.O. Snow and R.W. ,Ray, Inc. , dated
February 8 , 1985 and revised March 15 , 1985 and recorded in the
Clerk' s Office of said County in Deed Book 863 , page 233 , said
manhole being the one lying closest to the southwestern boundary
of the 14 . 954 acre tract shown on said plat; to upgrade, enlarge
and increase the capacity of the existing sanitary sewer line
lying between said sanitary sewer manhole and the subject
property, and its connection thereto, so that there will be
sufficient capacity to serve the future sanitary sewer needs of

maintain and operate said existing sanitary sewer line and any
upgraded replacement thereof; and
(2) a non-exclusive easement across the 14 . 954 acre tract
for the construction, maintenance and use for ingress and egress
of such highway entrance flaring and acceleration lane along
State Route 742 as may be required by the appropriate
governmental authorities of Albemarle County, Virginia, for use
of the 60 ' Right of Way for vehicular access to the subject
property.
The property hereby conveyed is a portion of the property
conveyed to Robert Shoffner, Trustee,
by deed of Charles
Christian Shoffner and George Christian Shoffner, dated April
17 , 1970 , recorded in the Clerk' s Office of the Circuit Court of
Albemarle County, Virginia, in Deed Book 484 , page 546 , the
trust created in said deed having been extended for a period of
five (5) years by deed dated June 13 , 1980 , recorded in said
Clerk' s Office in Deed Book 781 , page 215. Said trust
terminated on June 13 , 1985 and by its terms title to the
aforesaid property vested in Noemi Gabriela Mayer de Shoffner,
George Christian Shoffner, Charles Christian Shoffner and Robert
Denebham Shoffner, as tenants in common.
This conveyance is made subject to the following
non-exclusive easements:
(1) a non-exclusive easement granted to MC Partnership for
ingress and egress , including the carrying of utilities , to and
from State Route 742 and across that certain strip of land sixty
feet (60 ' ) in width and four hundred feet (400 ' ) in length
abutting the southwestern boundary of the 14 . 954 acre tract
owned by MC Partnership, being shown and designated as "60 ' RN"
tha aforesaid plat of R.O. Snow & R. W. Ray, Inc. , dated
(2) a non-exclusive easement granted to MC Partnership for
the construction, maintenance and use for ingress and egress of
such highway entrance flaring and deceleration lane along State
Route 742 as may be required by the appropriate governmental
authorities of Albemarle County, Virginia, for the use of the
aforesaid 60 ' Right of Way for vehicular access to the aforesaid
14. 954 acre tract.
This conveyance also is made subject to the provisions of a
Road Maintenance Agreement dated December 12 , 1985, recorded in
the aforesaid Clerk' s Office in Deed Book 866 , page 391 , and to
easements , conditions, restrictions and reservations, if any,
contained in duly recorded deeds, plats and other instruments
constituting constructive notice in the chain of title to the
property hereby conveyed , which have not expired by a limitation
of time contained therein or have not otherwise become
ineffective.
