Dear Mr. Zappia:
This letter is to inform you that on September 13, 1988, during
the regular meeting of the Albemarle County Board of Zoning
Appeals, your application for VA-88-49 was approved.
This variance approval allows relief from Section 30. 5. 6. 2 . 1 of
the Albemarle County Zoning Ordinance to reduce the setback for
a freestanding business sign in the Scenic Areas-Highway District
from one hundred fifty (150) feet to ten (10) feet.

ZONING: RA (Rural Areas)
LOCATION: South side of Rt. 250, +/- . 2 miles west of
its intersection with Rt. 691
The applicant seeks a variance from sections 30. 5. 6. 2 . 1 and
30. 5.7 . 2 (b) of the Albemarle County Zoning Ordinance, which
states:
"30. 5. 6.2 SA-Highways
30. 5. 6. 2 . 1 No buildings or structures other than necessary
accessory appurtenant fences and/or walls, except
as hereafter provided in the case of certain signs,
shall be constructed within any SA-Highways Overlay
District. . . .
30. 5.7 .2 Regulation of Number, Height, Area, Types of Signs . .
30. 5.7. 2 (b) Free-standing business and projecting business signs
shall be limited to ten (10) feet in height above
grade, eighteen (18) square feet per single sign face,
and to one (1) sign per separate highway frontage. "
The applicant proposes to erect a free-standing business sign and
seeks a reduction of the setback from the Route 250 right-of-way
from the minimum requirement of one hundred fifty (150) feet to
ten (10) feet and to increase the allowable size of the sign from
the maximum allowable sign area of eighteen (18) square feet to
thirty-seven (37) square feet.
The applicant proposes to erect the new sign at the same location
as an existing, non-conforming sign structure. The applicant
cites the curvature of Route 250 and the difference in elevation
of the road surface in relationship to his property as a hardship.
At the point where the sign is to be located, the grade of the
applicant's property is approximately fifteen (15) feet higher
than the roadway.

RECOMMENDATION
The application should be approved for cause:
1. The applicant has provided sufficient evidence to show
that a strict application of the Zoning Ordinance would
produce a clearly demonstrable hardship approaching con-
fiscation as distinguished from a special privilege or
convenience.
2 . The applicant has demonstrated that the perceived hardship
is unique to his property in contradistinction to other
properties in the same zoning district and general
vicinity. The requirement the applicant seeks relief from
is shared by all properties zoned Rural Areas.
3 . The applicant has provided evidence to demonstrate
that the authorization of the variance will not be of
substantial detriment to the adjacent properties or that
the character of the district will be altered.
