Dear Mr. Yousef:
This letter is to inform you that on August 9, 1988, during
the regular meeting of the Albemarle County Board of Zoning
Appeals, the Board granted your variance request for VA-88-50.
This variance approval allows relief from Section 30.5.7 .2 (c) of
the Albemarle County Zoning Ordinance to allow two (2) business
wall signs within the Scenic Areas-Highway District, a variance
of one (1) wall sign, and to allow the second wall sign to be
ten (10) square feet.
Your sign permit application is subject to approval by the
Director of Planning. Our office will forward your application
to the Planning Department.

LOCATION: Located on the north side of Route 250, +/- . 1
miles east of its intersection with Route 240
The applicant seeks a variance from section 30. 5. 7 . 2 (c) of the
Albemarle County Zoning Ordinance, which states:
"30. 5.7 . 2 Regulation of Number, Height, Area, Types of Signs
30. 5.7 . 2 (c) Business wall signs shall be limited to twenty (20)
feet in height above grade, thirty-five (35) square
feet per single sign face, and to one (1) sign per
separate highway frontage. "
The applicant proposes to erect a wall sign and seeks an increase
in the number of wall signs allowed per highway frontage in the
Scenic Areas - Highway Overlay District from the maximum of one
(1) such sign to two (2) signs. The proposed sign has a sign
area of approximately ten (10) square feet. The additional sign
is to be used to identify a new retail establishment which is to
be located on the property. At present the applicant operates a
retail business on the property and has a second structure in
which the new business is to be located. The second wall sign is
needed to identify the structure in which the new business is to
be located. The aggregate area of the existing and proposed wall
signs is thirty (30) square feet.
RECOMMENDATION
The application should be approved for cause:
1. The applicant has provided evidence that a strict
application of the ordinance would produce a clearly
demonstrable hardship approaching confiscation as
distinguished from a special privilege or convenience.

2 . The applicant has demonstrated that the perceived hardship
is unique to his property in contradistinction to other
properties in the same zoning district and general
vicinity.
3 . The applicant has provided evidence to demonstrate that
the authorization of the variance will not be of substantial
detriment to the adjacent properties or that the character of
the district will be altered.
