YOUSEF and BRENDA J. YOUSEF, husband and wife, (Grantors ) , and J. Benjamin Dick and David J. Wood, Jr. , Trustees, of Charlottesville, Virginia, WITNESSET • H: In consideration of $10 . 00 and other valuable consid- eration, Adnan M. Yousef and Brenda J. Yousef, husband and wife, hereby CONVEY, BARGAIN, and SELL with General Warranty of Title, to-wit: All that certain lot or parcel of land together with improvements thereon and appurtenances thereunto belonging consisting of two parcels as follows : (a) a parcel having 3/10th of an acre, fronting 217 . 7 feet on the northern side of U. S. Highway 250, lying about 15 miles west of the City of Charlottesville, Virginia, and being shown on a plat recorded in the Clerk ' s Office of the Circuit Court of Albemarle County, Virginia, in deed Book 276 , page 244 ; and (b) an adjoining parcel of approximately 15/100ths of an acre of land which is more particularly described in the deed of conveyance wherein said two parcels of land were conveyed to Charlotte West Willinger (now Charlotte W. Cochran) by deed of Kenneth S . Wood and wife bearing date July 7 , 1954 , of record in said Clerk' s Office in Deed Book 311 , page 340 , and being the same property in all respects conveyed to Adnan M. Yousef and Brenda J. Yousef, husband and wife by Meredith T. Bickers by deed dated August 14 , 1986 , and recorded in said Clerk' s Office simultaneously with the said deed. IN TRUST, to secure a debt of the said grantors for SEVENTY FIVE THOUSAND ( $75, 000 . 00 ) DOLLARS evidenced by a bond of even date executed by the grantors to bearer with 10o interest per annum from date thereof payable to bearer for ten ( 10 ) years in monthly payments of $991. 13 each, beginning September 14 , 1986 , and on the 14th day of each month thereafter until paid in full. Payments when made shall be applied first to interest and then to principal. Makers reserve the right to prepay at any time in whole or in part without penalty under said bond. Homestead exemption is hereby waived. The grantors hereby covenant with the Trustees and the holder of the bond that they will do nothing to impair the value of the property and insure the property for insur- able value for loss, and pay all taxes when due and payable before penalty is added. SUBJECT TO CALL UPON DEFAULT RENEWAL, EXTENSION, AND REINSTATEMENT PERMITTED RIGHT OF ANTICIPATION RESERVED As soon after default as requested by the creditor secured or the Trustees think proper, they shall proceed at once to take possession of the property and rent it until sale or payment of the amount then due hereunder. ADVERTISEMENT REQUIRED: The trustees shall sell the land in front of the County of Albemarle Courthouse for cash at public auction after advertising the property, time, place, and terms of sale for twenty days by handbills posted at five or more places in the County of Albemarle, Virginia, -2- or by advertising five times preceding the sale in some newspaper of general circulation in the County of Albemarle and by such additional advertisement as the Trustees shall think best and in accordance with the laws of Virginia. The proceeds of the sale shall be disbursed as follows : First, the cost of executing the trust, including a 5% commission to the Trustees ; second, to the holder of the bond so much thereof as shall be unpaid; and, third, to the grantors, the balance, if any. In the event the Trustees are requested to sell the property described and the bondholder thereafter requests the sale to be called off, the grantors agree to pay the Trustees a reasonable fee for services rendered in connection with the proposed sale.
