Dear Ms. Ofrias:
This letter is to inform you that on August 9, 1988, during
the regular meeting of the Albemarle County Board of Zoning
Appeals, the Board granted your variance request for VA-88-51
subject to using the same sign and that the sign design be
approved by the Zoning Administrator.
This variance approval allows relief from Section 30. 5. 6. 2 . 1 of
the Albemarle County Zoning Ordinance to reduce the setback in
the Scenic Areas-Highway Overlay District from one hundred fifty
(150) feet to five (5) feet.
Your sign permit application is subject to approval by the
Director of Planning. Before your application can be forwarded to
the Planning Department, you will need to submit two copies of the
sign specifications.

LOCATION: Located on north side of Rt. 250 west just
west of the Ivy Exxon business
The applicant is requesting relief from section 30.5. 6.2 . 1 of the
Albemarle County Zoning Ordinance. This section states:
"30.5. 6.2 . 1 No buildings or structures other than permitted
under section 4 . 11, except as hereafter provided
in the case of certain signs, shall be constructed
within any SA-highways overlay district. (Amended
12-2-87)
The applicant is requesting the Board of Zoning Appeals to reduce
the setback in the Scenic Areas Overlay District from one hundred
fifty (150) feet to five (5) feet.
The Board in its action of July 9, 1985 meeting granted approval
of a variance for the setback of a sign from the required one
hundred fifty (150) feet to five (5) feet. A sign of less than
eighteen (18) square feet was submitted with the application, and
thus approved by and made a part of the approval for the variance.
The staff recommends that the Board approve the variance based on
the applicant's agreement to maintain the existing sign's
aggregate area, and its present location.
RECOMMENDATION
The Board should approve the variance because:
1. That a strict application would produce a hardship on the new
tenant because of the location of the road right-of-way being
only approximately ten (10) feet from the front of the
building.
2 . The hardship is unique in the fact that three (3) previous
variances have been approved by the Board of Zoning Appeals
for an identical setback request.
3 . If the variance was granted, there is no evidence to show
that it would be a detriment to the adjacent properties, or
change the character of the district.
