Total 128 • 15- STAFF PERSON: Marcia Joseph PUBLIC HEARING: December 19, 1991 ARB-F(SIGN) -91-44 Shoney's at Rio Road DESCRIPTION: Tax Map 45, Parcel 94A, Charlottesville Magisterial District, Zoned Planned Development Shopping Center. LOCATION: Located on the west side of the south bound lane of Route 29, just south of its intersection with Woodbrook Road. PROPOSAL: To add two (2) new wall signs and move the existing sign on the existing pole closer to Route 29 . HISTORY: Rio Hill Shopping Center received a variance (VA-88-57) for signage on the site. This will allow for the area for wall signs to be computed by multiplying the linear foot of frontage by one and five tenths (1. 5) feet. The entire shopping center wall signs must not exceed 2 , 400 square feet. The existing pole sign at Shoney's currently extends over the parking area. The applicant proposes moving this sign to the opposite side of the pole, and off setting the menu board to remain parallel to Route 29 . There is no change in color or lettering proposed. This movement will make the sign encroach six (6) feet within the thirty (30) foot sign setback. The sign measures ninety-six (96) square feet. The applicant is proposing no reduction in area. This is seventy-eight (78) square feet greater than allowed within the Entrance Corridor, and within the allowable one hundred (100) square feet in the underlying district. The applicant states in his justification that: 1) because the sign pole is on the -setback line that the sign must be "flagged" into the parking lot; 2) the sign is lost to traffic north and south bound by the larger signs on either side and 3) the sign has been damaged by vehicular movement within the parking lot. Staff cannot support the applicants requests. As the photographs indicate the sign is visible from the directional light at the Rio Road/29 intersection and at the Woodbrook/29 intersection. The six (6) foot advancement toward Route 29 will not significantly improve the visibility of this sign. /, Staff Report - ARB-91-44 Shoney's Page 2 The sign inhabits a prominent position on the site in relation to Route 29, the base of the pole is six (6) feet - seven (7) feet above the travelway. This places the top of the sign approximately thirty-two (32) feet above Route 29, and sixteen (16) feet higher than allowed in the Entrance Corridor. The automobile dealership sign and the shopping center sign were in existence prior to any construction that had begun on this site. The competition between these signs does not justify grounds for a variance request. If the applicant feels that the sign is a hazard within the parking area and would like to remove the hazard, he can also: 1) remove the menu board, this is the portion of the sign that is lowest and therefore becomes damaged or 2) remove one parking space (he has one more than is required) and move the sign back, flag it toward Route 29 and maintain the required setback. The building currently exhibits two (2) wall signs. One is located on the awning parallel to Route 29 . The lettering is white on a field of green. This measures twelve (12) square feet. The other sign is located in the rear of the building, on the service side; the lettering is white on a field of red. The rear sign measures twelve (12) square feet and is not visible from Route 29 . The applicant proposes placement of two (2) additional wall signs below roof peak and above the door level on the north and south faces of the building. The wall signs proposed will each measure thirty (30) square feet. The variance received on this site allows for this site to have wall signs two hundred (200) square feet in total area on this building. This is based on the linear frontage of the building. This building fronts Route 29 (85 linear feet) and Myers Drive (57 linear feet) . The area proposed for thel`-'dll signs complies with the variance, the location does not. The proposed wall sign facing south (Myers Drive) is in compliance. The proposed wall sign facing north is not. The wall signs proposed will be highly visible from both the north and south bound lanes of Route 29 . Staff cannot support this request because it will add to the visual clutter on the site. Staff suggests that the Architectural Review Board act favorably upon this request if the following suggestions are submitted: 1) Remove the menu board from the freestanding sign. 2) Reduce the height and square footage of the freestanding sign to conform to the current ordinance requirements. 3) Eliminate one of the wall signs proposed and propose a uniform color for the wall sign that will be compatible with the building colors and adjacent businesses.
