Burgess, Jr. Zoning Administrator CWBJr/st cc: VA-88-64 STAFF REPORT - VA-88-64 APPLICANT: Ronald Eugene Riggs TAX MAP/PARCEL: 27/18 ZONING: RA (Rural Areas) ACREAGE: 2 .101 LOCATION: Located on the west side of Rt. 810, +/- . 5 miles south of the intersection of Rt. 614 The applicant seeks a variance from Section 10.4 of the Albemarle County Zoning Ordinance to subdivide the property into two (2) lots and to reduce the required front setback requirement. The following section states: "10.4 Area and Bulk Regulations Yards Minimum Front . . . 75 feet Minimum Lot Size 2 . 0 acres" The applicant wishes to subdivide an existing parcel of 2 . 101 acres into two (2) lots of approximately 1 +/- acre, requiring a variance of one (1) acre for each lot. A reduction of the front setback of seventy five (75) feet, to twenty-five (25) feet is sought by the applicant too. There are two (2) single family one-story residences existing on the 2 .101 acre parcel, along with a well house, and shed type building. The north property line abuts the Moormans River which is located within the SA (Scenic Areas Overlay) District. The property is also located within Flood Zone A where base elevations and flood hazard factors have not been determined, but is within the 100 year flood plain limit. The applicant proposes for each lot to be self supporting via means of its own well and septic system. RECOMMENDATION The application should be denied for cause: 1) The applicant has not provided evidence that a strict application of the ordinance would produce a clearly demonstrable hardship approaching confiscation as dis- tinguished from a special privilege or convenience. 2) The applicant has not demonstrated that the perceived hardship is unique to his property in contradistinction to other properties in the same zoning district and general vicinity. 3) The applicant has not demonstrated that the authorization of the variance will not be of substantial detriment to the adjacent properties or that the character of the district will not be altered.
