Dear Mr. Kessler:
This letter is to inform you that on November 8, 1988, during
the regular meeting of the Albemarle County Board of Zoning
Appeals, your application for VA-88-65 was approved.
This variance approval allows relief from Sections 4 . 15. 3 . 3 and
15. 3 of the Albemarle County Zoning Ordinance to increase the sign
area allowed for an identification sign from the maximum area of
two (2) square feet to thirty-nine (39) square feet and to reduce
the required setback for an identification sign from twenty-five
(25) feet to one (1) foot.

ZONING: R4 (Residential)
LOCATION: Located on the east side of Timberwood
Boulevard, +/- . 5 miles south of its
intersection with Route 29 .
The applicant seeks a variance from Sections 4. 15.3 . 3 and 15. 3 of
the Albemarle County Zoning Ordinance, which states:
"4 . 15. 3 Permitted Signs
4 . 15. 3 . 3 Residential (R-2 and R-4)
Identification Signs: provided: (a) not more than two (2)
square feet in area . . . "

The applicant proposes to erect an identification sign for the
Forest Lakes Swim and Tennis Club and seeks a variance to increase
the size of the sign from the maximum allowable area of two (2)
square feet to thirty-nine (39) square feet and to reduce the
setback for the sign from the minimum requirement of twenty-five
(25) feet to one (1) foot. The sign is to be located in a
landscaped median at the entrance to the swim and tennis club.
The proposed wood and masonry sign has an overall height of
approximately seven (7) feet and is of similar design to other
subdivision signs to be erected throughout the Forest Lakes
development. The applicant states that the Zoning Ordinance
signage provisions are not adequate to identify the swim and
tennis center. The staff is inclined to agree with the applicant.
The applicant's request to reduce the sign setback to one (1) foot
is caused by both the curvature of Timberwood Boulevard to the
South and in an effort to maximize visibility of the sign to
motorists. The applicant states that the proposed location of the
sign will not adversely effect sight distance at the intersection.
Recommendation
The application should be approved for cause:
1) The applicant has demonstrated that the zoning ordinance
has created a hardship in that no provision is made for
signage adequate to identify the swim and tennis club
development.

(2) The applicant's hardship is not generally shared by other
properties in the general vicinity or same zoing district.
(3) The authorization of the variance will not be of sub-
stantial detriment to the adjacent properties nor will
the character of the district be altered.
