Dear Dr. Schulman:
This letter is to inform you that on October 11, 1988 during
the regular meeting of the Albemarle County Board of Zoning
Appeals, your application for VA-88-73 was approved as requested.
This variance approval allows relief from Section 4 . 12 . 6. 6. 2
of the Albemarle County Zoning Ordinance to reduce the
the number of off-street parking spaces for a veterinary
hospital from the required thirty (30) spaces to sixteen (16)
spaces.

LOCATION: Southside of Rt 240, across from the Acme
Visible Records facility.
The applicant seeks a variance from Section 4. 12 . 6. 6.2 of the
Albemarle County Zoning Ordinance to reduce the number of required
parking spaces for a veterinary hospital from thirty (30) to
sixteen (16) spaces. The following section states:
"4 . 12 . 6. 6.2 Schedule of Specific Requirements For Number
of Off-Street Parking Spaces . . .
Veterinary Clinic: One (1) space per (100)
square feet of gross floor area exclusive of
that area to house animals. "
The applicant has pending an application for a Special Use Permit
to relocate an animal hospital on adjacent property to the
existing facility. A reduction in the number of required parking
spaces is requested by the applicant. A requirement that is the
same as retail or based on high volume walk-in traffic is cited by
the applicant as reasons for reevaluation of the requirements.
Todays business is mostly by appointment, and necessary
emergencies are worked into the normal day scheduling. The new
outpatient scheduling functions so that people coming to the
clinic are met by people leaving, which maintains a maximum of
patrons at the facility at any given time. Exception to the
schedule would be an emergency case.
Information -
County Zoning Ordinance - as amended in 1977 and which was in
effect until the adoption of the current ordinance (December 10,
1980) provided for:
11-7-7 Required Number of Off-Street Parking Spaces
11-7-1(1) Animal Hospital and Commercial Kennels:
One (1) space per four hundred (400) square
feet of gross floor area plus one (1) per each
employee.

RECOMMENDATION
The application should be denied for cause:
(a) The applicant has not provided sufficient evidence
to show that a strict application of the Zoning
Ordinance would produce a clearly demonstrable
hardship approaching confiscation as distinguished
from a special privilege or convenience.
(b) The applicant has not demonstrated that his perceived
hardship is unique to his property in contradistinction
to other properties in the same zoning district.
(c) The authorization of the variance should not be of
substantial detriment to the adjacent properties or
alter the character of the district.
