LOCATION: South side of Route 250, +/- . 3 miles west of
its intersection with Route 689 .
The applicant seeks a variance from Section 30. 5. 6.2 . 1 of the
Albemarle County Zoning Ordinance, which states:
"30. 5. 6.2 SA-Highways
30. 5. 6.2 . 1 No buildings or structures other than permitted
under Section 4 . 11, except as hereafter provided
in the case of certain signs, shall be constructed
within any SA-highways overlay district . . . "
The Scenic Highway District is established in Section 30. 5. 2 . 2,
which states:
"30.5.2. 2 SA-HIGHWAYS
SA-Highway overlay districts are hereby established along the
the following highway corridors in Albemarle County for a distance
of one hundred fifty (150) feet on each side of the right-of-way:
a. U.S. Route 250 from the western corporate limits of the City
of Charlottesville to the western Albemarle County border. "
The applicant proposes to construct a twenty (20) foot by
twenty-nine (29) foot addition to the north side of an existing
commercial structure and seeks a reduction of the front setback
from the minimum requirement of one hundred fifty (150) feet to
one hundred fifteen (115) feet. The applicant states that the
addition is an expansion of the store which provides products for
the campers at the Jellystone Park Campground. The existing store
area has an area of approximately fifteen (15) feet by twenty-nine
(29) feet. The additional area of the existing structure contains
the campground manager's residence. In order to construct the
addition in compliance with the one hundred-fifty (150) foot
setback requirement, the floor plan of the structure would have to
be altered substantially. The applicant also states that
construction of an addition on the south side of the existing
structure is restricted by the flood plain of Stockton Creek.

RECOMMENDATION
The application should be approved for cause:
1) The applicant has demonstrated that the SA-highways setback
requirements do create a hardship in the reasonable use of
the property.
2) The hardship is not generally shared by other properties in
the general vicinity.
3) The authorization of the variance will not be of detriment
to the adjacent properties nor will the character of the
district be altered.

the regular meeting of the Albemarle County Board of Zoning
Appeals, your application for VA-88-75 was denied.
Anyone aggrieved by a decision made by the Board can appeal
the decision to the Circuit Court of Albemarle County within
thirty (30) days of the decision.
