Dear Mr. Rhoads:
This letter is to inform you that on November 8, 1988, during
the regular meeting of the Albemarle County Board of Zoning
Appeals, that your application for VA-88-76 was approved subject
to the following conditions:
1) Square footage of sign to be limited to 12 square feet, and
2) Height of sign to be limited to 6 feet.
This variance approval allows relief from Section 30. 5. 6.2 . 1
of the Albemarle County Zoning Ordinance to reduce the setback
for a freestanding sign from one hundred fifty (150) feet to
one (1) foot.

OWNER: Scottsville Congregation of Jehovah's Witnesses

ZONING: Rural Areas (RA)
LOCATION: North side of Route 6, +/- .4 miles west of
its intersection with Route 726
The applicant seeks a variance from Section 30.5. 6. 2 . 1 of the
Albemarle County Zoning, which states:
"30. 5. 6. 2 SA-Highways
30. 5. 6. 2 . 1 No buildings or structures other than permitted
under Section 4 . 11, except as hereafter provided
in the case of certain signs, shall be constructed
within any SA-highways overlay district. . . "
The Scenic Highway District is established in Section 30. 5.2 .2,
which states:
"30. 5.2 .2 SA-HIGHWAYS
SA-highway overlay districts are hereby established along the
following highway corridors in Albemarle County for a distance of
one hundred fifty (150) feet on each side of the right-of-way:
c. Virginia Route 6 from the corporate limits of the Town
of Scottsville westward through several discontinuous
portions of Albemarle County. "
The applicant proposes to erect a freestanding sign and seeks a
reduction of the front setback from the minimum requirement of one
hundred fifty (150) feet to one (1) foot. The applicant's
property fronts on a portion of Route 6 which has a right-of-way
width of fifty (50) feet. The front property line of the
applicant's property is approximately twenty-seven (27) feet from
the edge of the pavement of Route 6. It should also be noted that
the elevation of the applicant's property at the front property
line is approximately ten (10) feet higher than the elevation of
the Route 6 pavement. This fact coupled with the required
setback of one hundred fifty (150) feet would cause the
freestanding sign to not be visible to passing motorists. Even
with a reduction of the required setback to one (1) foot, the
staff has doubts as to the visibility of the sign to passing
motorists due to the distance (27 feet) between the front property
line and the Route 6 pavement.

RECOMMENDATION
The application should be approved for cause:
1) The applicant has demonstrated that the SA-highways setback
requirements do create a hardship in the placement of a
freestanding sign on the property.
2) The hardship is not generally shared by other properties in
the general vicinity.
3) The authorization of the variance will not be of detriment
to the adjacent properties nor will the character of the
district be altered.
