LOCATION: West side of Route 616, +/- .7 miles north of
its intersection with Interstate 64.
The applicant seeks a variance from Section 10.4 of the Albemarle
County Zoning Ordinance, which states:
"10.4 Area and Bulk Regulations . . .
Yards, minimum . . .
Front. . . . 75 feet . . . "
The applicant proposes to construct an addition to the west side
of the existing dwelling and seeks a reduction of the front
setback from the minimum required measurement of seventy-five (75)
feet to sixty-one (61) feet. The existing dwelling is situated
approximately eighty (80) feet from the closest point of the
private right-of-way. The applicant cites the original placement
of the nineteenth century home as being the causing factor for the
variance request. The proposed addition will be to the west and
south sides of the existing dwelling. It should be noted that the
addition on the west side will extend approximately twelve (12)
feet past the front of the existing dwelling.
RECOMMENDATION
The application should be denied for cause:
1) The applicant has not provided sufficient evidence to
show that a strict application of the Zoning Ordinance
would produce a clearly demonstrable hardship approaching
confiscation as distinguished from a special privilege
or convenience.
2) The applicant has not demonstrated that the perceived
hardship is not shared by other properties in the same
zoning district and the same vicinity.
3) The authorization of the variance would not be of
detriment to the adjacent properties nor would the
character of the district be altered.

Dear Mr. & Mrs. Sisson:
This letter is to inform you that on November 8, 1988, during
the regular meeting of the Albemarle County Board of Zoning
Appeals, that your application for VA-88-78 was approved.
This variance approval allows relief from Section 10.4 of the
Albemarle County Zoning Ordinance to reduce the front setback
from seventy-five (75) feet to fifty-five (55) feet to allow
construction of an addition to a dwelling.
