Dear Mr. Carswell:
This letter is to inform you that on December 13 , 1988, during
the regular meeting of the Albemarle County Board of Zoning
Appeals, the Board ruled to grant your variance with the
condition that the sign not be illuminated.
This variance approval allows relief from Section 30. 5. 6. 2 . 1
of the Albemarle County Zoning Ordinance to reduce the setback
for a freestanding sign from one hundred fifty (150) feet to
thirteen (13) feet.

LOCATION: South side of Route 250, +/- . 2 miles east of its
intersection with Rodes Drive.
The applicant seeks a variance from Sections 30. 5. 6. 2 . 1 and
30. 5.7. 2 (b) of the Albemarle County Zoning Ordinance, which states:
"30.5. 6. 2 SA-HIGHWAYS
30.5. 6.2 . 1 No buildings or structures other than permitted
under Section 4. 11, except as hereafter provided
in the case of certain signs, shall be constructed
within any SA-highway overlay district.

30. 5.7.2 REGULATION OF NUMBER, HEIGHT, AREA, TYPES OF SIGNS
b. Free-standing business and projecting business
signs shall be limited to ten (10) feet in
height above grade, eighteen (18) square feet
per single sign face, and to one (1) sign per
separate highway frontage. "
The Scenic Areas-Highway Overlay District is established in
Section 30.5. 2 .2 of the Albemarle County Zoning Ordinance, which
states:
"30.5. 2 .2 SA-HIGHWAYS
SA-highway overlay districts are hereby established
along the following highway corridors in Albemarle
County for a distance of one hundred fifty (150)
feet on each side of the right-of-way.
a. U.S. Route 250 from the western corporate
limits of the City of Charlottesville to
the western Albemarle County border. "
The applicant proposes to erect a freestanding sign and seeks a
reduction of the required setback from Route 250 from the minimum
measurement of one hundred fifty (150) feet to thirteen (13) feet
and to increase the height of the sign from the maximum allowable
height of ten (10) feet to thirteen (13) feet. The proposed sign
has an area of approximately seven (7) square feet.

The applicant states that the difference in elevation of the
property and the pavement of the Route 250 right-of-way is the
causing factor of the variance requests. It should also be noted
that the applicant's front property line is located approximately
twenty-six (26) feet from the edge of pavement of Route 250. The
proposed location of the freestanding sign would therefore be
approximately thirty-nine (39) feet from the paved right-of-way.
RECOMMENDATION
The application should be approved for cause:
1) The applicant has demonstrated that the topography of the
property in relationship to the right-of-way has caused a
clearly demonstrable hardship.
2) The demonstrated hardship is not generally shared by other
properties in the same zoning district and general vicinity.
3) The g anting of---the applicant's request will not be of
substantial detriment to the adjacent properties nor, will

district be altered.
