Dear Mr. Crenshaw:
This letter is to inform you that on February 14, 1989, during
the regular meeting of the Albemarle County Board of Zoning
Appeals, your application for VA-88-80 was approved for a period
of twelve (12) months.
This variance approval allows relief from Section 5. 8 of
the Albemarle County Zoning Ordinance to allow temporary use
of a mobile home as an office, without prior approval of a
site plan.
Please note that according to Section 35. 0 of the Zoning
Ordinance, the applicant is responsible for paying any expenses
incurred by the County during the processing of the application.
Therefore, you are required to reimburse the County for $21. 27 .
The attached invoice shows a list of expenses.

The applicant seeks a variance from Section 5. 8 of the Albemarle
County Zoning Ordinance, which states:
"5. 8 TEMPORARY NONRESIDENTIAL MOBILE HOMES
A temporary nonresidential mobile home may be authorized
by the zoning administrator provided the mobile home is
used to house a planned permanent use and applicant
has received site plan approval for such permanent use
on the same site. The mobile home shall be removed
within thirty (30) days of issuance of a certificate of
occupancy for the permanent structure. Temporary non-
residential mobile home permits shall be subject to the
following conditions:
a. Site plan approval if applicable; . . . it
The applicant received approval of a variance (VA-88-21) on April
14, 1987, which allowed the use of a mobile home as temporary
office for a period of eighteen (18) months. The applicant now
requests a variance to extend the use of the mobile home as an
office for an additional eighteen (18) months. The office is
utilized by a used car sales and car rental business.
The staff believes that the Board of Zoning Appeals afforded the
applicant much consideration in granting the applicant's previous
request. During the past eighteen (18) months, the applicant has
apparently taken no steps to construct a permanent office
location. The staff believes that the present variance request
should be denied.
RECOMMENDATION
The application should be denied for cause:
1) The applicant has not provided sufficient evidence to show
that a strict application of the Zoning Ordinance would
produce a clearly demonstrable hardship approaching
confiscation as distinguished from a special privilege or
convenience.
2) The applicant has not demonstrated that the perceived
hardship is not generally shared by other properties in the
same zoning district and general vicinity.
3) The applicant has not provided evidence to demonstrate
that the authorization of the variance will not be of
substantial detriment to the adjacent properties or that
the character of the district will not be altered.
