Lincoln 1575 State Farm Blvd. Charlottesville, VA 22901 Re: Board of Zoning Appeals Action VA-88-86, Tax Map 39, Parcel 17D Dear Mr. Lincoln: This letter is to inform you that on January 10, 1989, during the regular meeting of the Albemarle County Board of Zoning Appeals, your application for VA-88-86 was approved. This variance approval allows relief from Section 10.4 of the Albemarle County Zoning Ordinance to reduce the lot area from the minimum requirement of two (2) acres to eighty-six hundreths ( . 86) of an acre to allow division of the property. Pursuant to Section 35.0 of the Albemarle County Zoning Ordinance, the actual cost of any notice required under the code shall be taxed to the applicant, to the extent that the same shall exceed the applicable fee set forth in this section. STAFF REPORT - VA-88-86 APPLICANT: Marie Haigh TAX MAP/PARCEL: 39/17D ACREAGE: 3 acres ZONING: RA (Rural Areas) LOCATION: Located on the south side of Old Orchard Road, +/- . 6 miles north of its intersection with Rt. 684 The applicant seeks a variance from section 10.4 of the Albemarle County Zoning Ordinance, which states: "10. 4 Area and Bulk Regulations Minimum lot size 2 acres . . . . " The applicant at present has a three (3) acre parcel upon which two (2) single-family dwellings exist. The dwellings were constructed in the mid 1950's. As a part of her Last Will and Testament, the applicant desires to bequeath a dwelling to each of her two (2) children. The applicant seeks a variance to reduce the minimum lot size for one of the parcels from the required two (2) acres to eighty-six hundreths ( .86) of an acre. The second parcel will contain two and fourteen hundreths (2 . 14) acres. In that the two (2) dwellings exist, the staff believes the granting of the variance would not be detrimental to the adjacent properties. The only concern is whether or not the smaller parcel is of sufficient size to provide adequate area for a back up septic drainfield. RECOMMENDATION The application should be approved for cause: 1. The applicant at present has two (2) dwellings on her property and the Zoning Ordinance has created a hardship by requiring a minimum lot area of two (2) acres per existing dwelling. 2 . The applicant's hardship is not generally shared by other properties in the general vicinity. 3 . The granting of the variance request will not be of substantial detriment to the adjacent properties, nor will the character of the district be altered.
