This variance approval allows relief from Sections 26. 10. 2 and 26. 10. 3 of the Albemarle County Zoning Ordinance to reduce the parking area setback and buffer zone required from an adjacent residential district from the minimum measurement of thirty (30) feet to five (5) feet. Sieg Company TAX MAP/PARCELS: 59/23C, 23D, and 23F ZONING: Light Industry (LI) LOCATION: North side of Route 250, +/- . 1 miles west of its intersection with Ednam Drive The applicant seeks a variance from Sections 26. 10. 2 and 26. 10. 3 of the Albemarle County Zoning Ordinance, which states: "26. 10 MINIMUM YARD REQUIREMENTS 26. 10.2 Adjacent to residential districts: No portion of any structure, except signs advertising sale or rental of the property, shall be located closer than fifty (50) feet to any rural areas or residential district and no off-street parking space shall be closer than thirty (30) feet to any rural areas or residential district 0000 26. 10. 3 Buffer zone adjacent to residential and rural areas districts: No construction activity including grading or clearing of vegetation shall occur closer than thirty (30) feet to any residential or rural areas district. Screening shall be provided as required in section 32 .8. " The applicant proposes to construct new commercial/industrial structures and seeks a variance to allow the off-street parking lot areas to be located five (5) feet from the north property line. The adjacent property is zoned Rural Areas. The applicant is required to maintain a thirty (30) foot buffer and thirty (30) foot parking area setback from the adjacent Rural Areas property. The unique aspect of the applicant's predicament is that the adjacent Rural Areas property is a railroad right-of-way with a width of approximately seventy (70) feet. The property to the north of the railroad tracks comprises a portion of the Farmington Subdivision. The question is whether or not the setback and buffer area is a relevant requirement when the adjacent property contains a portion of an active railroad track system. The staff believes that in this situation the setback and buffer area requirements serve no practical purpose. RECOMMENDATION The application should be approved.
