DESCRIPTION OF REQUEST: Developer requests a reduction of the rear harking
setback from 30' to 5' .
JUSTIFICATION FOR REQUEST: Compliance with the 30' rear parking setback
coupled with the scenic highway building setback severely restricts the potential
uses of the property. FurtheLmore, the purpose of the 30' rear parki g setback
would be served due to the railway easement, a 50-75' right-of-way, which runs
behind the subject property buffering it from adjoining parcels.

Zoning Ordinance applicable to this application.
