Box 119 Charlottesville, Va. 22902 December 27, 1988 Board of Zoning Appeals County of Albemarle Department of Zoning 401 McIntire Road Charlottesville , VA 22901-4596 Re : 0wensville Pentecostal Church Petition for Variance to Allow Creation of 1.4 acre lot from Three Existing Parcels Att: Board of Zoning Appeals We favor the referenced applicants request for variance and seek the Board' s support of their petition. Our property is directly across the street from the church. Presently there exists three non-conforming lots with two non- conforming structures, both of which are dilapidated and unused. Application of regulations now permit building 3 structures on the three lots , or rebuilding the church plus two other structures , all of which would be exempt from certain current regulations because of grandfather provisions . Therefore , to deny the church' s petition is to perpetuate and exacerbate these non-conformaties subject to grandfather provisions . On the other hand, granting their petition would create a new lot available to the church for all the uses permitted in the zoning district subject to all current regulations and requirements except for the lot area, which is the variance being sought. It appears to us that the church' s petition is in the public interest because it eliminates an abundance of non-conformities and brings their property as close as it can be to a conforming lot in the district. What the church chooses to do with the newly created lot as a matter of right or by special use permit is a separate matter. We believe the church' s petition is one ideally suited to the powers of the Board of Zoning appeals to grant relief when literal enforcement of provisions result in unnecessary hardship, because the church was virtually demolished after being rammed by a car, leaving two structurally sub-standard buildings that would be extraordinarily expensive to bring into compliance with Health, Safety, and Building Codes . Even then, they would still be non-conforming. Additionally, these three small and irregularly shaped lots were created prior to Albemarle County having a zoning or sub-division ordinance and are the remains of sub-division of larger parcels adjacent to it. This is a condition not generally shared by other properties in the district and vicinity. Finally, we believe granting the church' s petition for variance will be less of a detriment to our and other adjacent properties than not granting the petition, and that the character of the district will be more likely to be retained since the new lot would be limited to one primary structure and that structure would have to meet current standards .
